Resolutions - Consent RESOLUTION: 2025-105 Resolution To Declare Lead Agency For The Proposed Action 2025 Comprehensive Plan Update And Chapter 240 Zoning Law Amendments WHEREAS, the Town of Wappinger's Town Board, believes that changes are necessary to provide more effective control over the placement of certain multifamily and commercial uses to allow more certainty in the application of the uses, and to ensure that multifamily and commercial uses are placed within areas that can be reasonably served with municipal water and sewer and other infrastructure; and WHEREAS, pursuant to Section 272a of the NYS Town Law, the Town of Wappinger Town Board has determined that such changes require an update to the existing 2010 Town Comprehensive Plan and existing zoning to effectively execute the proposed changes; and WHEREAS, the Town of Wappinger Town Board has hired Laberge Group to prepare recommendations for the updates to the existing 2010 Town of Wappinger Town Plan and also recommend amendments to locally adopted zoning to enact such updates to the Town Plan; WHEREAS, recommended updates are discussed in the document entitled "Town of Wappinger 2025 Comprehensive Plan Updates" (hereinafter referred to as "2025 Plan Updates"), and Chapter 240 Zoning Amendments (referred to hereinafter as "Zoning Amendments"), are also included as part of this proposed action; and WHEREAS, the adoption of the 2025 Plan Updates and Zoning Amendments is a Type I action under SEQRA, per NYCRR 617.4 (b); and WHEREAS, the Town Board is the only entity that can legislatively adopt these recommended updates, thus, the Town Board seeks to serve as the Lead Agency for the proposed action; and WHEREAS, the Town Board has prepared and reviewed Part 1 of a Full Environmental Assessment Form ("FEAF") as part of advancing review of this proposed action; and Town of Wappinger Page 2 Printed 6/25/2025 Regular Meeting Minutes May 12, 2025 WHEREAS, the proposed action would not involve a federal agency; and WHEREAS, the Town Board is required to refer the proposed 2025 Plan Update and Zoning Amendments to the Wappinger Planning Board for review; and WHEREAS, the Town Board is also required to refer the 2025 Plan updates and Zoning Amendments to the Dutchess County Planning Board under GML 239-m; and WHEREAS, the Dutchess County Planning Board review and the Wappinger Planning Board review are both considered an advisory opinion, therefore, neither board is considered to be eligible for Lead Agency status under SEQRA in this action. NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Wappinger in regular session duly convened as follows: 1. The Town Board of the Town of Wappinger hereby determines that the Project is a Type 1 Action under SEQRA and declares itself Lead Agency pursuant to SEQRA and its implementing regulations at 6 NYCRR §617.6 (b)(1) with respect to the proposed action to adopt a 2025 Plan Update and Zoning Amendments. 2. The Town Board of the Town of Wappinger hereby directs the referral of the proposed "2025 Plan Update and Zoning Amendments" to the Dutchess County Planning Board for review and recommendation pursuant to New York General Municipal Law §239-m. 3. The Town Board of the Town of Wappinger hereby directs the referral of the proposed "2025 Plan Update and Zoning Amendments" to the Wappinger Planning Board for review and recommendation. The Town Board authorizes and directs the Town Clerk to notice the identified involved and interested agencies of this action classification and Lead Agency declaration. 4. The Town Board hereby directs the Town Clerk to send notification of the public hearing to all adjoining municipalities. RESOLUTION: 2025-108 Resolution Declaring May As "Mental Health Month" In The Town Of Wappinger WHEREAS, mental health is essential to everyone's overall health and well-being, and WHEREAS, all Americans experience times of difficulty and stress in their lives, and WHEREAS, prevention is an effective way to reduce the burden of mental health conditions, and WHEREAS, there is a strong research that animal companionship, humor, spirituality, religion, recreation, social connections, and work -life balance can help all Americans protect their health and well-being, and WHEREAS, mental health conditions are real and prevalent in our nation, and WHEREAS, with effective treatment, those individuals with mental health and other chronic health conditions can recover and lead full, productive lives, and WHEREAS, each business, school, government agency, healthcare provider, organization and citizen shares the burden of mental health problems and has a responsibility to promote mental wellness and support prevention efforts, and NOW THEREFORE BE IT RESOVLED, that the Town Board of the Town of Wappinger hereby proclaims May 2025 as Mental Health Month and call upon the citizens, government agencies, public and private institutions, businesses and schools in Wappinger to recommit our community to increasing awareness and understanding of mental health, the steps our citizens can take to protect their mental health, and the need for appropriate and accessible services for all people with mental health conditions. RESOLUTION: 2025-111 Resolution Introducing Local Law Of 2025 Amendment To Chapter 230-45, Schedule Xi Old Troy Road and Smithtown Road Weight Limit WHEREAS, the Town Board is considering the adoption of Local Law No. _ of 2025 which would amend Chapter 230-45 of the Town Code with respect to Schedule XI to add a weight limit of 10,000lbs for vehicles traversing Old Troy Road and Smithtown Road (the "Proposed Action"); and WHEREAS, for the purposes of the New York State Environmental Quality Review Act (SEQRA), the Proposed Action is as defined above; and WHEREAS, the Town Board has determined that the Proposed Action is an Unlisted Action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA"); and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action; and WHEREAS, a Determination of Significance has not yet been made with respect to the Proposed Action. Paoloni Initiator: MinuteTraq Admin Sponsors: DOC ID: 6392 Resolution Introducing Local Law Of 2025 Amendment To Chapter 230-45, Schedule Xi Old Troy Road and Smithtown Road Weight Limit WHEREAS, the Town Board is considering the adoption of Local Law No. _ of 2025 which would amend Chapter 230-45 of the Town Code with respect to Schedule XI to add a weight limit of 10,000lbs for vehicles traversing Old Troy Road and Smithtown Road (the "Proposed Action"); and WHEREAS, for the purposes of the New York State Environmental Quality Review Act (SEQRA), the Proposed Action is as defined above; and WHEREAS, the Town Board has determined that the Proposed Action is an Unlisted Action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA"); and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action; and WHEREAS, a Determination of Significance has not yet been made with respect to the Proposed Action. NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: 1. The Town Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein. 2. The Town Board hereby introduces for consideration of its adoption proposed Local Law No. of 2025 in the form annexed hereto. 3. The Town Board hereby schedules a Public Hearing regarding the adoption of the annexed proposed Local Law No. _ of 2025 for 7:00 PM on the 27th day of May, 2025 and the Town Clerk is hereby directed to post the notice of the Public Hearing in the form annexed hereto and to publish same in the Southern Dutchess News and the Poughkeepsie Journal not less than ten (10) days prior to said Public Hearing date. 4. The Town Board hereby directs the Town Clerk to act as follows with respect to the proposed Local Law: a. To serve a copy of this resolution, the annexed proposed Local Law, and the public hearing notice to the municipal clerk of each abutting municipality not less than ten (10) days prior to said public hearing; b. Legislative Intent The Town Board believes that it is reasonable and appropriate to amend Chapter 230-45 of the Town Code to amend Schedule XI" in order exclude trucks over the weight of five (5) tons or 10,000 lbs from Old Troy Road, except for local deliveries only. Old Troy Road is a one way, short, narrow road with limited sight distances at its intersections which was designed to serve a limited number of residences but instead has become a cut through street for vehicles avoiding traffic on New York State Route 9D and has caused concerns regarding the longevity of the roadway. The Town Board believes that it is reasonable and appropriate to amend Chapter 230-45 of the Town Code to amend Schedule XI" in order exclude trucks over the weight of five (5) tons or 10,000 lbs from Smithtown Road, except for local deliveries only. Smithtown Road is a narrow with significantly sharp turns and limited sight distances at its intersections which was designed to serve a limited number of residences but instead has become a cut through street for vehicles avoiding traffic on US Route 9 and has caused concerns regarding the longevity of the roadway. A weight limitation will limit the amount of traffic on Old Troy Road and Smithtown Road by reducing the number of vehicles that would be permitted to use it, particularly vehicles over five tons. This local law is determined to be an exercise of the police powers of the Town to protect the public health, safety and welfare of its residents. Section 3. Amendments to Chapter 230-45 Schedule XI: Trucks Over Certain Weights Excluded.
