LOCAL LAW NO. #3_ OF THE YEAR 2003
A Local Law entitled "Local Law No. #3 of the Year 2003, Authorizing a Partial
Real Property Tax Exemption for Veterans."
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger Local Law No.
#-j entitled as "Local Law No. 113 of the Year 2003, Authorizing a Partial Real Property
Tax Exemption for Veterans".
Section II: Legislative Intent and Purpose:
It has come to the attention of the Town Board that the New York State
Legislature has authorized an increase in the real property tax exemption for
Veterans not to exceed Twenty Seven Thousand Dollars ($27,000) or the product of
Twenty Seven Thousand Dollars ($27,000) multiplied by the latest State
equalization rate for the Town of Wappinger, whichever is less. In addition to the
exemption for qualifying residential real property, an additional exemption for
Veterans who served in a combat theatre shall be made available to those Veterans
that provide documentation of an award of the United States Campaign Ribbon or
Service Medal which shall not exceed Eighteen Thousand Dollars ($18,000), or the
product of Eighteen Thousand Dollars ($18,000) multiplied by the latest State
equalization rate for the Town of Wappinger, whichever is less. In addition to the
exemptions for qualified residential real property and Veterans who served in a
combat theatre, an additional exemption for Veterans who received a compensation
rating from the United States Veterans Administration or from the United States

Department of Defense because of a service connected disability shall be provided
which shall not exceed Ninety Thousand Dollars ($90,000), or the product of
Ninety Thousand Dollars ($90,000) multiplied by the latest State equalization rate
for the Town of Wappinger, whichever is less. The Town Board recognizes the
contribution that Veterans.make to the quality of life for the residents of the Town of
Wappinger and the Town Board determines that it is appropriate to acknowledge
this contribution in the form of real property tax relief. Consequently, the Town
Board has determined that to the extent that additional real property tax relief is
authorized by the New York State Legislature for Veterans, the Town of Wappinger
is best served by providing such additional relief.
Section III:
Town Code of the Town of Wappinger, Article III "Veteran's Exemption", Chapter
221-8 "Maximum Tax Exemptions" is amended to read as follows:
"ARTICLE III
Veteran's Exemption
221-8. Maximum Tax Exemptions. Pursuant to the authority set forth in the
New York State Real Property Tax Law §458-a (2) (d) (ii), the maximum tax
exemptions allowable to Veterans shall be increased as follows:
A. The exemption for qualifying residential real property shall not exceed
Twenty Seven Thousand Dollars ($27,000), or the product of Twenty
Seven Thousand Dollars ($27,000) multiplied by the latest State
equalization rate for the Town of Wappinger, whichever is less.
B. In addition to the exemption provided in subdivision (A) of this
section, where a Veteran served in the combat theatre or combat zone
of operations, as documented by the award of the United States
Campaign Ribbon or Service Medal, the additional exemption for
qualifying residential real property shall not exceed Eighteen
Thousand Dollars ($18,000), or the product of Eighteen Thousand
Dollars ($18,000) multiplied by the latest State equalization rate for
the Town of Wappinger, whichever is less.

C. In addition to the exemptions provided in subsections (A) and (B) of
this section where the Veteran received a compensation ratings from
the United States Veterans Administration or from the United States
Department of Defense because of a service -connected disability, the
additional exemption for qualified residential real property shall not
exceed Ninety Thousand Dollars ($90,000) or the product of Ninety
Thousand Dollars ($90,000) multiplied by the latest State equalization
rate for the Town of Wappinger, whichever is less.
Section IV: Separability.
The provisions of this Local Law are separable and if any provision, clause,
sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or
inapplicable to any person or circumstance, such illegality, invalidity, or
unconstitutionality, or inapplicability, shall not affect or impair any of the remaining
provisions, clauses, sentences, subsections, words or parts of this local law or their
application to other persons or circumstances. It is hereby declared to be the legislative
intent of the Town Board of the Town of Wappinger that this Local Law would have
been adopted if such illegal, invalid or unconstitutional provision, clause, sentence,
subsection, word or part had not been included therein, and if such person or
circumstance to which the Local Law or part thereof is held inapplicable had been
specifically exempt therefrom.
Section V: Effective Date:
This Local Law shall become effective immediately upon filing with the
Secretary of State as provided by law and shall be deemed retroactive from January 1,
2003.
