LOCAL LAW NO. #9 OF THE YEAR 2002
A Local Law entitled "Local Law No. #9 of the Year 2002, Revising the Salary of the
Superintendent of Highways for Calendar Year 2002."
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger "Local Law No. #9 of
the Year 2002, Revising the Salary of the Superintendent of Highways for Calendar Year 2002",
which shall revise the present salary of the Superintendent of Highways salary, as set forth
below.
Section II: Legislative Intent•
The Town Board intends to assign additional duties of overseeing and managing the
Town Recycling Center to the Superintendent of Highways.
Additionally, it has come to the attention of the Town Board that the annual salary of
the Superintendent of Highways is not on par with the salaries paid by neighboring
municipalities to Highway Superintendents with Highway Departments and road systems of
similar or less size and with similar duties and responsibilties. Accordingly, the Town
Board has determined that it is appropriate to increase the salary of the Town's
Superintendent of Highways by the sum of $10,000.00 for Calendar Year 2002.
Section III: Salary Increase:
The annual salary of the Superintendent of Highways of the Town of Wappinger for
the fiscal year 2002, which is the Calendar Year of 2002, is hereby increased by S 10,000.00
from S54,121.00 to S64,121.00.

Section IV: Separability.
The provisions of this Local Law are separable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this local law or their application to other persons or circumstances. It is hereby declared
to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law
would have been adopted adopted if such illegal, invalid or unconstitutional provision, clause,
sentence, subsection, word or part had not been included therein, and if such person or
circumstance to which the Local Law or part thereof is held inapplicable had been specifically
exempt therefrom.
Section V: Effective Date:
This Local Law shall not become effective until filing with the Secretary of State of the
State of New York as provided by the Municipal Home Rule Law and not until at least forty-five
(45) days after its adoption; nor shall this Law become effective until approved by the
affirmative vote of a majority of the qualified electors of the Town of Wappinger voting on a
proposition for its approval if within forty-five (45) days after its adoption there be filed with the
Town Clerk a petition protesting against such Local Law, signed and authenticated as provided
by Section 24 of the Municipal Home Rule Law of the State of New York by qualified electors
of the Town of Wappinger, registered to vote therein at the last preceding general election, in
number equal to at least Ten Percent (10%) of the total number of votes cast for Governor in the
last gubernatorial election in the Town of Wappinger.
