LOCAL LAW NO. #9 OF THE YEAR 2003
A Local Law entitled "Local Law No._ of the Year 2003, Exempting Senior Citizens
from Town Dog Licensing Fees".
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger "Local Law No. #9 of
the Year 2003, Exempting Senior Citizens from Town Dog Licensing Fees", which will authorize a
Town dog licensing fee exemption to dog owners aged sixty-five (65) or over, as set forth below
Section II: Legislative Intent:
It has come to the attention of the Town Board of the Town of Wappinger that the New
York State Legislature, pursuant to Section 110 (4)(b) of the Agriculture and Markets Law,
authorizes municipalities to exempt dog owners who are aged sixty-five (65) years or over from
the payment of additional dog licensing fees set by any Town pursuant to Local Law.
The Town Board has determined that it is appropriate to amend the Local Law No. 7 of
the Year 1978 in order to implement the Town dog licensing fee exemption authorized by the
New York State Legislature for those dog owners who are aged sixty-five (65) years or over
from the payment of such additional Town dog licensing fees.
Accordingly, it has been determined that to the extent that dog licensing fee relief is
authorized by the New York State Legislature for senior citizens among the Town of Wappinger
and best served by providing such additional relief. The Local Law No. 7 of the Year 1978 shall
be amended by the provisions of this Local Law.

Section III:
Section 2 of the Local Law No. 7 of the Year 1978 is hereby amended to read as follows:
"Section 2.
A. Commencing on the effective date of this Local Law, license fees
for dogs, in addition to other statutory charges, is hereby set as follows:
a. $4.50 for a spay or neutered dog;
b. $9.50 for an unspayed or unneutered dog, not including a
$3 fee for New York State anti -animal population control.
B. Senior Citizen dog owners, who are sixty-five years of age or
older, shall be exempt from the payment of all additional Town dog
licensing fees notwithstanding the mandatory statutory fees enumerated in
Sections 110(1) and 110(2) of the Agriculture and Markets Law."
Section IV: Separability.
The provisions of this Local Law are separable and if any provision, clause, sentence.
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this local law or their application to other persons or circumstances. It is hereby declared
to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law
would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence,
subsection, word or part had not been included therein, and if such person or circumstance to
which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.
Section V: Effective Date:
This Local Law shall become effective immediately upon filing with the Secretary of
State as provided by law.
