RESOLUTION AUTHORIZING REFUND OF UNUSED ESCROW FUNDS
FROM 55 LOSEE ROAD
The following Resolution was introduced by Mr. Paoloni and seconded by
Mr. Valdati
WHEREAS, there remains an escrow balance for 55 Losee Road, Application No.
A017506, Building Permit No. 98-842, in the amount of Two Thousand and Five Hundred
Dollars ($2,500.00); and
WHEREAS, the Applicants Peter Catano and Linda Catano have requested the return of
the escrow balance in a letter dated July 3, 2002 addressed to the Town of Wappinger Town
Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. That payment is approved in the amount of Two Thousand and Five Hundred
Dollars ($2,500.00) made payable to Peter Catano and Linda Catano for the
refund of the unused escrow funds deposited for the driveway and seeding for the
premises located 55 Losee Road, Application No. A017506, Building Permit No,
98-842.
The foregoing was put to a vote which resulted as follows:

Please note that these four items were placed on the Preliminary Plot
Plan filed from this office dated November 3id 1998, and were an
integral part of that conditional acceptance.

1. All the clearing necessary to achieve sight distance to be accomplished to the satisfaction of the
Highway Superintendent. This work was to be done prior to any foundation work. The sight distance
that was achieved was supposed to be shown on a revised plot plan, which was never submitted to this
office. In any event, the sight distance, as it exists today, shall be acceptable to the Highway
Superintendent or the Builder should take whatever steps necessary to achieve the same.
2. An appropriate earthen berm was to be placed along the east edge of the property to divert the roadside
runoff into the existing catch basin and not the driveway. This should be done or an escrow account in
the amount of $500.00 should be maintained with the Town to insure completion.
3. All Federally regulated wetlands were to be shown on a revised map, and the necessity of any permit
that might have been required from the Army Corp of Engineers was to be explored. Any Federally
regulated wetlands should be shown on the Final Plot Plan. There should also be a note placed on the
Final Plot Plan that any intrusion into the Federally regulated wetlands may require the issuance of a
permit by the Army Corp. of Engineers.
4. It should be noted that the water service connection shown on the Final Plot Plan is not connected at
this point but put in for future use.
5. Stabilization of all newly disturbed areas or escrow account in the amount of $1,000.00 should be
maintained with the Town. Temporary soil erosion control measures to be placed in the ditch line at the
northern property line until grass is stabilized.
