RESOLUTION AUTHORIZING REFUND OF UNUSED ESCROW FUNDS FOR
20 APPLESAUCE LANE
At a regular meeting of the Town_ Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New
York, on the 8t' day of November, 2004, at 7:30 P.M.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll
being called, the following were present:
PRESENT: Supervisor- Joseph Ruggiero

ABSENT:
The following Resolution was introduced bymyaldatand seconded
WHEREAS, on or about September 13, 2004 Frank Buyakoski deposited Two
Thousand Five Hundred and 00/100 ($2,500.00) with the Town of Wappinger for seeding
for 20 Applesauce Lane, and
WHEREAS, Frank Buyakoski of Contrail, LLC has requested a refund in the amount of
One Thousand Five Hundred and 00/100 ($1,500.00) and has been recommended by
Salvatore Morello, Deputy Building Inspector to the Town of Wappinger, in his letter
dated October 19, 2004 to the Town Board Members.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully
set forth and adopted herein.
2. Payment is approved in the amount of One Thousand Five Hundred dollars
and 00/100 ($1,500.00) made payable to Frank Buyakoski of Contrail, LLC,
Account Number 2004-0200, for the refund of the unused escrow funds
deposited for the property located at 20 Applesauce Lane.
The foregoing was put to a vote which resulted as follows:

On OCTOBER 2004, I performed a field inspection for soil stabilization at the
above listed address. All newly disturbed areas from the construction of the house have
been seeded with a bed of hay or straw on top.
Additionally, condition placed by Planning Board to plant seven (7) evergreen trees
as shown on the approved preliminary Plot Plan a minimum of 25' off the edge of the
wetland area, has been met.
I recommend the return of the escrow amount of $1,500.00 to:
