ZONING BOARD OF APPEALS TOWN HALL SEPTEMBER 22ND, 1987 - 7:00 P.M. MIDDLEBUSH ROAD MINUTES WAPP. FALLS, N.Y. The regular meeting of the Zoning Board of Appeals was held on Tuesday, September 22nd, 1987, at the Town Hall, Middlebush Road, Wappinger Falls, New York, beginning at 7:00 P.M.. MEMBERS PRESENT: Mr. George Urciuoli, Chairman Mr. Michael Hirkala Mrs. Alberta Roe Mr. Jim Brooker OTHERS PRESENT: Ms. Linda Berberich, Secretary The meeting was called to order at 7:00 P.M.. Mr. Urciuoli asked for a motion on the Minutes of the August 25th, 1987 meeting. Mr. Urciuoli made a motion to accept the minutes. Mrs. Roe seconded the motion. Vote: All ayes The motion was carried. Mr. Urciuoli read the first appeal: Appeal 41002, at the request of Rev. Verner Matthews, seeking a variance of Article IV, §418 of the Town of Wappinger Zoning Oridnance where the proposed house is 960 square feet and the ordinance requires 1,200 square feet on property located on New Road, and being Parcel 46156-01-171580, in the Town of Wappinger. There was no one present. Mr. Hirkala stated, Mr. Chairman, due to the fact that this has been with us, how many times, 3 times, 3 or 4 meetings, I would like to initiate the recommendation of the Zoning Administrator and dismiss without prejudice. Mr. Brooker seconded the motion. Vote: All ayes The motion was carried. Mr. Urciuoli read the next appeal: Appeal 41010, at the request of John W. Vorndran, seeking a variance of Article IV, §430 &450 of the Town of Wappinger Zoning Ordinance to allow for an extension of time between construction on a lot which has had a Special Use on property located on Old All Angels Hill Road, and being Parcel #6257-02-950772, in the Town of Wappinger. John Vorndran was present. Mr. Urciuoli stated, this is the Special Use Permit which has been in existence for a number of years and it has had several extensions on it. I think one of the points on this particular request is that the Zoning Board really can't act and my own interpretation with a site plan that is outdated I think one of the recommendations is we forward the site plan to the Planning Board for review and site plan approval if there is anything -2 - that should be amended or updated. Mr. Hirkala stated, I would like to make a motion that we refer this application to the Planning Board in view of the fact that it is a site plan that might potentially be out dated and we would like to have their input as to whether or not they think this should be going back through the whole site plan, or the site plan is adequate and to have any further comments as to whether or not we should re -new this application. Mr. Brooker seconded the motion. Vote: All ayes The motion was carried. Mr. Urciuoli read the next appeal: Appeal #1011, at the request of Jeffrey J. Strang, seeking a Special Use Permit of Article IV, §421, 111 of the Town of Wappinger Zoning Ordinance to allow a children's nursery school on property located on 48 Old Route 9, and being Parcel 46157-02-580777, in the Town of Wappinger. Jeffrey J. Strang, 13 Ritter Drive, Wappinger Falls was present. There was a discussion as to the location of the property. Mr. Hirkala asked, aren't we supposed to get some of this stuff earlier so we have an idea of what is going on? Mr. Strang stated, you walk out of Grossman's parking lot and you walk right across the street into the yard. Mr. Hirkala stated, I thought we were supposed to have before us these types of things, site plan.... There was a brief discussion on the Special Use Permit process. Mr. Hirkala stated, I thought Herb was going to handle having more complete applications before we get them on the agenda. Mr. Urciuoli explained to Mr. Strang the procedure for the Special Use Permit process. Mr. Urciuoli stated, we just refer you to the Planning Board and they will ask you for a site plan that is a little more detailed than this showing where the cars will come in and where the children will be let off, where the play areas will be, how they are going to be screened and protected. Some of the concern is what the uses are going to be in the different buildings. Mr. Hirkala asked, do you own this property? Mr. Strang answered, no, I am in the process of purchasing it. Mr. Hirkala asked, does the contract to purchase have anything to do with this approval? Mr. Strang answered, contingent upon the approval, no. -3 - Mr. Hirkala stated, I know I am going to have a concern about what all these 3 buildings' are, what is going to happen to these buildings, what uses are going to be there or if they are going to remain there. I would like to have some justification or verification - for the non -conforming factor of those 3 buildings being there are being separate r` uses if they are that way now. Mr. Urciuoli stated, we refer you to the Planning Board. All we are saying is yes, a $i nursery school is a permitted use in that area. So you go to the Planning Board and then you start a site plan, how the cars are going to enter the property, exit the property, how many people are going to be employeed in the school, parking area for them, whether it is going to be blactopped, the landscaping that is involved, the screening that is involved from the road to protect the kids, the fencing area. Mr. Hirkala suggested that Mr. Strang make an appointment with the Zoning Administrator. r Mr. Hirkala stated, if there are going to be any changes to the site, any additional = buildings and also how, I would have a concern about the fact that if you utilize the one building for a nursery are you going to live on this property?" Mr. Strang answered, no. Mr. Hirkala asked, so everything is going to be strictly the day nursery or you are going to rent out space? Mr. Strang answered, strictly a day care center. Mr. Hirkala asked, so this one story wood frame building and the wooden cottage are not going to be rented out to a tenant? Mr. Strang answered, the main building will be a nursery school, the one story wood frame will be a nursery school, the other thing that is labeled a cottage, at this point no one could even live in it or use it as a school. I will probably take the next year to renovate that and it will also be another classroom. My fiancee anticipates having different age groups in the different houses. Mr. Hirkala asked, so you are going to use the entire parcel strictly for nursery school? Mr. Strang answered, absolutely. Mr. Brooker made a motion to refer this appeal to the Planning Board.
