The regular meeting of the Town of Wappinger Zoning Board was held on
Tuesday, October 24, 1989, at the Town Hall, Middlebush Road, Wappinger
Falls, NY 12590.

Mr. Brooker explained how the meeting would be conducted.
PUBLIC HEARINGS:
APPEAL #1071 AT THE REQUEST OF WILLIAM AND LORI CROUSHORE, SEEKING
VARIANCE OF ARTICLE IV SECTION 421 OF THE TOWN OF WAPPINGER ZONING
ORDINANCE THAT YOU MAINTAIN A 20 FOOT SIDEYARD AND A PROPOSED ADDITION
WILL REQUIRE A 10 FOOT SIDEYARD VARIANCE AND 6.4 FOOT SIDEYARD VARIANCE
WHERE IT'S PROPOSED TO BUILD AN ADDITION, ON PROPERTY LOCATED ON 34
PEGGY LANE AND BEING PARCEL #19-6157-03-432315, IN THE TOWN OF WAPPINGER.
Mr. Croushore was present.
Mr. Brooker: You are seeking a variance on the left side part of the
house?
Mr. Croushore: Yes.
Mr. Brooker: You already have a one car garage, is there a hardship on
having a two car garage?
Mr. Croushore: I'd like to have the second garage for convenient purposes,
Mr. Lehigh: Do you have a full basement in the house right now?
Mr. Croushore: Yes.
Mr. Tompkins: Looking at your elevation drawings I see the garage and
window along side of it.

r. Croushore: The drawing on the top is the current elevations as to
hat it looks like today.
Mr. Lehigh: Are you going to do away with the porch?
Mr. Croushore: Yes.
Mr. Tompkins: Is any part of your garage going to be an additional family
room?
Mr. Croushore: No.
Mr. Brooker: A storage room?
Mr. Croushore: Yes, basically for the cars and lawn mowers.
Mr. Lehigh: Did we hear back from the neighbors?
Mr. Levenson: We have heard no response from the neighbors.
Mr. Hirkala: Overall, how many feet are going to be added on the existing
structure?
Mr. Croushore: 20 feet added on.
Hirkala: so your going to increase the amount of living space in the
"Ifouse. You have a 12 ft. garage now and your going to add another 25 ft.
onto that?
Mr. Croushore: The existing garage is 12 foot wide.
Mr. Hirkala: Are you going to have a 32 foot garage or is the inside
of the house going to be renovated?
Mr. Croushore: 32 feet of garage (back garage)
Mr. Hirkala: So your going to have 32 feet of garage.
Mr. Croushore: We may down the road, do some renovations.
Mr. Hirkala: Did you receive in your packet what a variance is for.
One of the first reasons is a hardship. I'd like to hear your reasons.
Mr. Croushore: The overall reasons would be for storage, and storage of
lawn mowers.
Mr. Brooker: That is not an hardship. The law is specific.
Mr. Croushore: well, my wifes car is outside........
r. Brooker: The law is specific.

Tompkins: Mr. Croushore, if you put an addition of 10 feet on the
' arage that would give you a 20 foot garage, you wouldn't even need a
variance because you would be within the 20 feet sideyard and setback
requirements. You can do that without coming to us.
Mr. Hirkala: There are alternative methods.
Mr. Brooker: Would you be willing to live with the 20 foot, for a
wide garage?
Mr. Hirkala: All the other houses have a one car garage.
Mr. Lehigh: I really don't see a hardship here.
Mr. Lehigh made a motion to close the public hearing.
Mrs. Roe seconded the motion.
Vote: All ayes.
The motion carried.
Mr. Hirkala made a motion to declare a Negative Declaration.
Mrs. Roe seconded the motion.
Vote: All ayes.

2. APPEAL #1072, AT THE REQUEST OF ROBERT AND EMILY SMITH SEEKING A
VARIANCE OF ARTICLE IV SECTION 421, OF THE TOWN OF WAPPINGER ZONING
ORDINANCE, WHERE 20 FOOT SIDES ARE REQUIRED AND THE APPLICANT IS
REQUESTING A 10 FOOT VARIANCE ON PROPERTY LOCATED ON 30 BALDWIN DRIVE
AND BEING PARCEL #19-6257-02-559936, IN THE TOWN OF WAPPINGER.
Mr. Lehigh: Do you have any other dimensions on the other lot?
Mr. Hirkala: There are no other dimensions anywhere. How large
is the lot? Is the house 80 feet wide? Is it in the R-20 zone?
Mr. Smith: Yes.
Mr. Tompkins: Is it 100 feet in the rear?
Mr. Smith: Yes.
Mr. Tompkins: You have no garage there now?
Mr. Smith: That's right.

. Tompkins: You bought the house this way?

Mr. Smith: Yes.
Mr. Lehigh: How long has the house been there?
Mr. Smith: I would say around twelve years.
Mr. Hirkala: Is this an illegal lot?
Mr. Levenson: There was a special consideration granted by the Planning
Board in the subdivision.
Mr. Tompkins: The garage is 20 feet wide?
Mr. Smith: Yes.
Mr. Tompkins: You are only requesting a 10 feet. What happens to the
other 2 feet?
Mr. Levenson: He's requesting a variance of 8 feet. The distance
between the lot line and the garage is 12 feet.
Mr. Tompkins: Again, do you have a hardship that you need a two car
garage.

V Rr. Brooker: If you built a one car garage, you wouldn't even have to
come to us.
Mr. Smith: All the other houses in the development have a two car garage.
Mr. Hirkala: What are the set backs?
Mr. Smith: The set backs are 10 feet.
Mr. Tompkins: How many cars are in your family?
Mr. Smith: Four.
Mr. Lehigh: Are you going to have a hard time juggling the cars?
Mrs. Roe: Well, if he is the only one in the development that has not been
done on that piece of property, I think we should bend the rules a little
so he can have it.
Mr. Lehigh: Due to the Planning Board granting an undersize one lot in
that development, the gentlemen has shown an unique circumstance that has
show hardship.
Mrs. Roe made a motion to close the public hearing.
