Resolution Accepting Proposed Benefit Assessment Rolls for Special Improvement Districts
and Special Improvement Areas for Fiscal Year 2009 and Setting a Public Hearing for
Objections Thereto
Councilman Beale made a motion to open the Public Hearing at 7:06 PM. The motion
was seconded by Councilman Bettina and passed unanimously. Town Clerk Chris Masterson
offered for the record the Affidavits of Posting and Publication, duly signed and notarized (These
Affidavits are attached hereto and made a part thereof the Minutes of the Public Hearing).
Al Roberts, Town Attorney, explained the purpose of the Public Hearing. Supervisor
Colsey opened the floor to comments from the public.
Joe Incoronato was the first resident to speak. His comments were about the revenues
and expenditure lines for the Fleetwood Water District. The 2009 Budget cites an amount to be
raised of $47,692. Compared to the $31,437 in the 2008 Budget, this is a 51% increase. He
asked how this could be. The other item he was concerned about was that the projected revenues
for 2009 are $43,503. That is $5,593 less than the current year revenues. He asked what this
11% decline in revenues is due to. Mike Tremper, from CAMO Pollution Control, was present
to answer the resident's concerns. Mr. Tremper and Fredrick Awino, Town Accountant, gave a
brief explanation. Mr. Incoronato and Mr. Tremper agreed to have a more in-depth conversation
offline. Councilman Bettina asked that he be provided with the breakdown of the increase.
Discussion followed.
Councilman Bettina made a motion to close the Public Hearing. The motion was
seconded by Councilman Paoloni. Councilman Paoloni noted that the public just voted for the
75% increase in the Grinnell Library budget. He went on to say that this is not reflected in the
Preliminary Budget. He asked how this would be affected if the Board does not agree when
imam setting the Final Budget. Al Roberts explained that the increase has to be incorporated as the
referendum trumps the Town budget process.
The motion to close the Public Hearing passed unanimously.

Resolution Calling Special Town Board Meeting to Adopt Fiscal Year 2009 Budget
Councilman Bettina made a motion to open the Public Hearing at 7:18 PM. The motion
was seconded by Councilwoman McCarthy and passed unanimously. Town Clerk Chris ..r
Masterson offered for the record the Affidavits of Posting and Publication, duly signed and
notarized (These Affidavits are attached hereto and made a part thereof the Minutes of the Public
Hearing).
Fredrick Awino presented the fund balances. He noted that the fund balance has been
depleted and that there is no fund balance to be appropriated for 2009. Discussion followed.
Councilman Paoloni commented that he had received documentation from the New York State
Comptroller's Office that shows that there was a $1.1 Million year-end 2007 fund balance. He
believes there should be more available. Supervisor Colsey opened the floor to the public.
Joan Bertolini was the first resident to speak. She asked what is or isn't being put into the
budget for street and curb repair. She feels the work hasn't been adequately done in 25 years.
Graham Foster, Highway Superintendent, gave the resident the line number and pointed out that
there is no money in that line. The resident wanted to know why there is no money. She stated
that it is required maintenance and there needs to be money in there. Mr. Foster explained that
there is nothing in that line for curbs or paving. Paving is done by bonding. He went on to say
that he asks for money in the budget, but, each year since 1990, the line has been reduced. The
resident replied that she is "tired of hearing this story" and noted that it should be put in the
budget. Supervisor Colsey asked if the resident is asking that money be put in for maintenance
and curbing. The resident confinned. Councilwoman McCarthy brought up a bond that was
passed in 2003 that authorized several million Dollars for road repairs and curbs. She notes that
some of that bond was drawn down. She claimed that she had asked the Supervisor and Town
Clerk to provide her with information about this Resolution, but they have not provided her with
anything and she is still waiting. The Supervisor has assured the Councilwoman that the curbing now
topic would be on a future Agenda for discussion. Supervisor Colsey confirmed that he had
promised that this would be on a future Agenda and he went on to summarize discussions lie has
had with Sal Pennini. Discussion followed. Councilman Beale asked if the Town could make a
curbing district. Al Roberts, Town Attorney, noted that he has already ruled on this. It is up to
the Town to fund it. Councilwoman McCarthy commented that this has been discussed over the
years and there is not consensus on how to fix the curbs. This is what is to be included in the
discussion. She will notify the residents when that occurs so that they can participate and offer
input. The resident asked for adequate notice so she will be able to sue the Town.
Councilwoman McCarthy assured the resident that she would.
Johanna Dengler was the next resident to speak. She had an issue with the manner in
which the Highway Superintendent is taking care of an easement that runs through her property.
She claimed that Walter Artus has told her it would be fixed and Mr. Foster has told her there is
no money. Mr. Foster pointed out that, due to MS4 regulations, the only way to clear this
easement is to cut the grass with snips. He can't touch the root structure and can't take equipment
in to muck it out like lie used to. This is a labor intensive task and there is no money in the
budget for it. Councilwoman McCarthy felt that there certainly needs to be solutions in place for
these issues. Mr. Foster recommended hiring people. Councilwoman McCarthy noted that she
is frustrated that the message from Town Hall is consistently "No we can't". The Board then
discussed two employees that were hired specifically for drainage and maintenance. Joseph
Ruggiero then gave a historical summary of the hiring of these employees and of this problem in
general. He then gave his opinion on the money available for the issues pertaining to curbs. "MW

June Visconti spoke next. She had read something in the newspaper that the Town Board
was trying to get the Budget down to a zero tax increase. She asked what the increase would be
with the adoption of this budget. Supervisor Colsey replied that it currently would be $1.31 per
$1000, ora 27% increase. Councilman Bettina added that the Board will need to do some
serious cutting and freezing. He is not going for the 27% increase. Councilwoman McCarthy
agreed. Discussion followed. Mrs. Visconti stated that she would rather see the Town maintain
all employee jobs and cut programs instead. Councilwoman McCarthy noted that the Board does
not want to cut salaries. She went on to note that the current Budget has projected salary
increases from 3 to 8% which she finds unacceptable. Supervisor Colsey corrected the

Councilwoman stating that he put in 3% increases. Councilman Bettina noted that there would
only be a decrease of 1 % in the Budget if all salaries are frozen. Discussion followed.
Councilman Bettina made a motion to close the Public Hearing. The motion was seconded by
Councilwoman McCarthy and passed unanimously. The Public Hearing closed at 8:01 PM.

Motion To: open Public Hearing for Community Development Block Grant

Resolution to Authorize a Public Hearing on the Intended Use of Community Development
Block Grant Funds
Councilman Bettina made a motion to open the Public Hearing at 8:01 PM. The motion
was seconded by Councilwoman McCarthy and passed unanimously. Town Clerk Chris
Masterson offered for the record the Affidavits of Posting and Publication, duly signed and
notarized (These Affidavits are attached hereto and made a part thereof the Minutes of the Public
Hearing).
Supervisor Colsey listed some of the ideas that have been put forth for the grant. Joe
Incoronato asked if the grant could be used to expand the Senior Center facility. Graham Foster,
Highway Superintendent, asked if the pipe infrastructure problems in Rockingham could be a
possibility for the grant. Councilman Bettina asked if the grant could be used to fix the Highway
garage facility. Al Roberts, Town Attorney, replied that it could. Councilman Beale mentioned
that there was an idea to expand the water pipes from Route 9 down to Fowlerhouse Road. He
would be interested in using the grant for this. Discussion followed. Councilman Bettina made a
motion to close the Public Hearing. The motion was seconded by Councilwoman McCarthy and
passed unanimously. The Public Hearing was closed at 8:07 PM.

Public Comments on the Agenda items
Louis DiCocco asked to address the Board. He had a longstanding concern about the
Zoning Department and claimed there is a lack of enforcement. He gave examples of properties
that were of concern to him. June Visconti recommended that the Board should be getting this
message in writing. She feels this is not the proper forum for this. Mr. DiCocco read his
statement for the Board. Discussion followed. Councilman Bettina and Councilman Beale noted
that the Board would be meeting with that department and will bring this issue up then.
Councilman Bettina made a motion to reinstate the Rules. The motion was seconded by
Councilman Beale and passed unanimously.

WHEREAS, the Town Board adopted Town Code Chapter 46: Procurement Policy, on
March 25, 1996; and
WHEREAS, the Town Board last amended Town Code Chapter 46: Procurement Policy

WHEREAS, national, state and local economic circumstances are of a concern to the
Town Board in respect to limiting expenses borne upon Town of Wappinger residents; and
WHEREAS, the Town of Wappinger is diligently reviewing the budget proposals for the
fiscal year of 2009, as due to be finalized no later than November 20, 2008.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes
Town Supervisor Christopher Colsey to suspend, through December 31, 2008, Town Code §46-
5(A), which states "$0 - $500 Purchase order signed only by department head. "
BE IT FURTHER RESOLVED that the Town Board hereby directs all proposed
purchase orders in accordance with Town Code §46-5(A) to be presented to the Town Supervisor
and Town Accountant prior to the initiation of any purchases.

Councilman Beale New Business
Councilman Beale asked that the additional street light on Steinhaus Lane in the
Hughsonville Lighting District be reflected in the Budget.
Councilman Bettina New Business
Councilman Bettina brought up the discussion item on the Agenda for the Building
WAM Department. He pointed out that his name is on the Agenda but lie did not request this meeting.
He went on to say that he thinks it is a good idea to have it. Councilman Paoloni clarified that
the Agenda has been amended and Councilman Bettina's name is not on that discussion item.
Councilman Bettina then asked the Supervisor to give the Board a schedule of where the
Town Patrol will be placing the speed trailer. Supervisor Colsey replied that he will update it.
Graham Foster, Highway Superintendent, commented that it will not be updated because it is
being taken off the road for the winter. The schedule is set by Lt. Watterson and emailed to Mr.
Foster. Mr. Foster can have the schedule emailed to the Town Board.
