Mr. Fanuele made a motion to approve the November 10, 1998, minutes.
Mr. Warren seconded the motion.
Vote: All present voted aye except Mr. diPierno since he was absent for that meeting.
PUBLIC HEARING
Appeal No. 98-7035 - At the request of Mr. & Mrs. Pylypshyn, who are seeking an area variance of Article
IV, Section 420.3 - Schedule of Dimensional Regulations - Whereas a 25 -foot side yard setback is required, the
appellants are proposing a 22 % foot setback, thus requiring a 2 `/2 foot side yard setback variance in order
to construct an addition (13' X 21') for a sunroom on property located at 160 Rosewood Drive and is
identified as Tax Grid No. 19-6257-04-644063-00 in the Town of Wappinger. The Zoning Board of Appeals
declared itself Lead Agency on November 10, 1998.

— Mr. Warren made a motion to open the public hearing.
Mr. diPierno seconded the motion.
Vote: All present voted aye.
Mr. Pylypshyn explained that he wants to put an addition (13' W X 21' D) onto his house. The corner of the
addition will extend into the required 25 foot setback by 2 %2 feet. He stated it was 2 %2 feet when the leaves
were up. All the leaves came down during the last storm, so he had to move the rope over 6 inches, which he
used to determine the property line. Now, he needs a 3 foot variance rather than a 2 i/2 foot variance.
Mr. Lehigh reminded everyone that Mr. Pylypshyn had agreed at the Workshop to enclose the bottom of the
addition so the pillars can not be seen.
Mr. Pylypshyn said he will use lattice. He asked if he could use fieldstone.
Mr. Lehigh said just as long as the pillars can not be seen.
There was no one present in the audience to speak for or against this project.
Mr. Fanuele made a motion for a Neg. Dec.
Mr. diPierno seconded the motion.
Vote: All present voted aye.
Mr. Fanuele made a motion to close the public hearing.
Mr. Warren seconded the motion.

Mr. Lehigh logged into evidence a letter from a neighbor, a plot plan, and drawings of the sunroom. He made a
motion in favor of granting the 3 foot side yard variance. The requested variance will not be detrimental to
nearby properties. It will not cause an undesirable change in the neighborhood. He did not see any alternative
method in order to do this without a variance. It is a minor variance of only 3 feet. The variance will not cause
any adverse effects to the environment. The difficulty is self-created.
Mr. diPierno seconded the motion.
Vote: All present voted aye.

,*mw Mr. Lehigh asked if anyone on the Board had any comments regarding the applications submitted by Mrs.
Nguyen.
The Board stated they are in favor of using the forms right away. They suggested Mr. Roberts should take a
look at the forms.
Mrs. Nguyen stated she already sent him a copy of each application.
Mr. diPiemo made a motion to adjourn the meeting.
Mr. Warren seconded the motion.
