1998-08-11Vol AGENDA Town of Wappinger Zoning Board of Appeals MEETING DATE: August 11, 1998 TIME: 7:30 PM Approval of July 14, 1998, minutes ADJOURNED PUBLIC HEARING Town Hall 20 Middlebush Road Wappingers Falls, NY -MOO Appeal No. 98-7024 - At the request of Fun Central, who is seeking a variance of Article IV, Section 410.12.6.2 - the applicant is proposing to enlarge the existing 24 square foot free standing sign for Fun Central to 36 square feet, whereas a 25 square foot sign is allowed, thus the appellant is requesting an 11 square foot sign variance for property located at 1155 Route 9 and is identified as Tax Grid No. 19-6158-04-551329-00 in the Town of Wappinger. The Zoning Board of Appeal declared itself Lead Agency on June 23, 1998. Site inspection - July 11, 1998. Mr. Warren seconded the motion. Vote: All present voted aye except Mr. Lehigh since he was absent for that meeting. (See letter in file dated July 30, 1998) Zoning Board of Appeals Summarized Minutes - August 11, 1998 Page 2 DISCUSSION John Mirabilio, Jr. - To discuss Appeal 98-7026 requesting a front yard setback variance for property located at 77 New Hackensack Road in the Town of Wappinger. Mr. John Mirabilio, Jr., property owner, was present. Mr. Mirabilio, Jr. explained that the house was built too close to the road on one corner. It is a modular home. The surveyor staked it out. He said he went behind the surveyor's stakes, and he still ended up on one corner too close. He stated the surveyor was in a bicycle accident after he (Mr. Mirabilio) put the footings in, so the surveyor could not come back to check them. Mr. Prager asked if the Town picked up on the discrepancy when they came to check the footings. Mr. Mirabilio, Jr. said no, there were no markers out front. There was only one flag in the corner, but the other corner the surveyor left out. The as -built shows where the flags were. Mr. Prager asked where Lakeside Road is located. Mr. Fanuele said Cedar Knolls. Mr. Lehigh asked about the driveway being on Lakeside Road. He did not believe Lakeside Road is an accepted Town road. Mr. Mirabilio, Jr. stated it is a private road. Mr. Fanuele said they have to have 50 feet on a Town Road. Mr. Lehigh said the front of the property is on New Hackensack Road. Mr. diPierno made a motion for the ZBA to be Lead Agency. Mr. Fanuele seconded the motion. Vote: All present voted aye. Mr. Lehigh made a motion for a Neg. Dec. Mr. Warren seconded the motion. Vote: All present voted aye. Mr. Prager set the public hearing for August 25th *`"' Mr. Mirabilio, Jr. stated there is a 1 foot overhang on the house. When the surveyor measured, he measured to the foundation. To be safe, he asked Mr. Mirabilio to bring in how much of a difference it would be. Mr. Mirabilio, Jr. stated the over hang is 12 inches wide. Mr. Fanuele stated he will need 1 ft. 9 inches of a variance. Mr. Prager said to be on the safe side, they should publish it as a 1 ft. 9 inch front yard variance. Mr. diPierno made a motion to adjourn the meeting. Mr. Lehigh seconded the motion. Vote: All present voted aye. MEETING ADJOURNED AT 7:40 PM.
