PUBLIC HEARING Town Hall 20 Middlebush Road Wappingers Falls, NY Appeal No. 1257 - The Appellant, Greer Nine Realty Corgi, seeks variances of Article IV, Section 410.12.6.1.4: Whereas, one hundred (100) square feet of signage is permitted on the front of the building (Route 9 side), the Appellant proposes 152 square feet, thus a 52 square foot sign variance is requested on the front of the building, and; Whereas, fifty (50) square feet of signage is permitted on the side of the building (Old Hopewell side), and the Appellant proposes 67 square feet, thus a 17 square foot sign variance is requested on the side of the building on property located at 1420 Route 9 and is identified as Tax Grid No. 19-6157-02-585606-00 in the Town of Wappinger. Appeal No. 1257 DISCUSSION: Nicholas & Cynthia Colarusso MINUTES Mr. Warren made a motion to approve the January 27, 1998, minutes. Mr. Fanuele seconded the motion. Vote: All present voted aye. The Zoning Board of Appeal declared itself Lead Agency on January 27, 1998. Mrs. Greer - Schunzel was not present. Mr. Prager went on to the next item on the agenda. DISCUSSIONS Nicholas & Cynthia Colarusso - To discuss Appeal No. 1258 requesting a 2 ft. side yard variance to construct a 20' x 28' garage on property located at 34 Brothers Road in the Town of Wappinger. Mr. Nicholas Colarusso was present. Mr. Colarusso stated there was a misprint regarding the size of the garage. He proposed a 20 X 20 garage. He explained he is in need of more room since his wife is expecting a baby in June. He wants to enclose the garage for more living space. He wants to put up a new garage to house his equipment since he is a mechanic. The size of the existing garage is 24 X 24, that is why he needs a new garage at least 20 X 20. Mr. diPierno asked what type of house he has. Mr. Colarusso stated a raised ranch with the garage located underneath. Mr. Prager asked how long he has lived in the house. Mr. Colarusso stated since January of 1990. Mr. Fanuele asked what type of equipment he planed to keep in the garage, other than the car. Mr. Colarusso stated he has a motorcycle, tool boxes, bicycles, and kids' stuff. He is a mechanic so he has a lot of tools. Mr. Prager asked if he plans to do mechanical work from his garage. Mr. Colarusso said no. Mr. Prager asked for a sketch plan. Mr. Colarusso submitted a survey of his property and a drawing of the house with the proposed garage. Mr. Fanuele stated the drawing shows a second floor on the proposed garage. Mr. Colarusso stated it would be used for storage. Mr. diPierno asked if Town water and sewer are available. Mr. Colarusso said yes, the shed is 10 X 10 in the vicinity of the garden. Mr. Prager asked for copies of the sketch and survey for the Board. TAPE TURNED OFF/ON (Mrs. Nguyen went to make copies.) Mr. Warren made a motion for the ZBA to be Lead Agency. Mr. diPierno seconded the motion. Vote: All present voted aye. Mr. diPierno made a motion for a Neg. Dec. Mr. Fanuele seconded the motion. Vote: All present voted aye. Mr. Prager set the public hearing for February 24'. Mr. diPierno made a motion to open the public hearing. Mr. Warren seconded the motion. Vote: All present voted aye. Mr. Prager asked if Mrs. Greer-Schunzel had brought in the items they had requested at the last meeting. cm Town of Wappinger Zoning Board of Appeals Summarized Minutes - February 10, 1998 Page 4 Mrs. Greer-Schunzel submitted a color photo. She did not bring the letter from Subaru and she could not find the letter from Toyota. Mr. Prager stated he received a copy of the building permit for the facia from Linda. Mr. diPierno asked if the signs will be interior lit. Mrs. Greer-Schunzel said no, they plan to have lights shinning onto the signs. She said they might put one light on a pole to shine onto the signs. She did not think it would interfere with the traffic. Mr. Prager reminded her that she has to be careful not to change the character of the neighborhood and the environment. He stated no one was in the audience except the previous appellant, Mr. Colarusso. He logged into evidence two sketches, ZBA minutes from January 27, 1998, and a letter from Don Close dated January 30, 1998. Mr. Fanuele made a motion for a Negative Dec. Mr. diPierno seconded the motion. Vote: All present voted aye. Mr. Fanuele made a motion to close the public hearing. Mr. diPierno seconded the motion. Vote: All present voted aye. Mr. Prager made a motion to grant the variance for the following reasons; It will not be detrimental to nearby properties. It will not create an undesirable change to the character of the neighborhood. Due to the size of the building, he did not feel there was an alternative for Greer. The signage on the Route 9 side will require a 52% variance, which he felt is substantial. The signage on Old Hopewell Road is not as substantial, which requires a 25% variance. He felt it would not cause an adverse effect on the physical and environmental conditions in the neighborhood. Mr. Fanuele seconded the motion. ROLL CALL: Mr. Warren: Granted. Mr. diPierno: Granted. Mr. Fanuele: Aye. Mr. Prager: Aye. Vote: All present voted aye. Mr. Prager explained the motion has been passed to grant the variance. It will be filed in 5 days.
