ADJOURNED PUBLIC HEARING Town Hall 20 Middlebush Road Wappingers Falls, NY Appeal No. 1256 - The Appellant, Greer Nine Really Corp., seeks variances of Article IV, Section 410.12.6.1.4: n2 Whereas, one hundred (100) square foot signage is permitted on the front of the building, the Appellant proposes 110.41 square feet, thus a 10.41 square foot sign variance is requested on the front of the building, and; Whereas, fifty (50) square foot signage is permitted on the side of the building, and the Appellant proposes 64 square feet, thus a 14 square foot sign variance is requested on the side of the building on property located at 1420 Route 9 and is identified as Tax Grid No. 19-6157-02- 585606-00 in the Town of Wappinger. The Zoning Board of Appeal declared itself Lead Agency on November 25, 1997. Mrs. Greer-Schunzel was present. Mr. Prager explained Mrs. Greer-Schunzel withdrew Appeal No. 1256 in a letter dated January 14, 1998. DISCUSSION Greer Nine Realtyoo. - To discuss Appeal No.1257 requesting a sign variance to exceed 100 square feet on the front of the building and half that on the side. The property is located at 1420 Route 9 in the Town of Wappinger. Mrs. Greer-Schunzel was present. Mrs. Greer-Schunzel explained she withdrew Appeal No. 1256 because she realized she had to measure the complete sign, not each letter separately. After finding that out, she had to submit a new application (Appeal No. 1257) because the total signage she was asking for was more than what the legal notice stated. She discussed the drawing that she submitted showing the proposed signage. She stated she kept the Subaru sign that faces Route 9, but she took off the Greer Toyota, LTD sign that used to be on the building. She added a Toyota and Greer sign on the front of the building facing Route 9 and she added, facing Old Hopewell Road, a Toyota and Subaru sign, without logos because she already met the manufacturers guidelines. She proposed 152 square feet of signage on the Route 9 side, whereas 100 square feet is allowed. Previously, she had 145 square feet of signage. Mr. Lehigh asked if she has a building permit to redo the facade on the building. Mrs. Greer-Schunzel said she was told she didn't need one since she was not building out. Mr. Close said that would be the Building Inspectors call. He said anything structural requires a building permit. Mr. Prager asked Mr. Close to check with the Building Inspector to find out if a building permit is required. Mr. Lehigh stated if she doesn't have a building permit for the facade, she would have to have one before the Board could have a public hearing. Mr. diPierno asked, what is the height and width of the front facia. `AW Mrs. Greer-Schunzel estimated it to be 6 feet high and 60 feet wide. She stated on the side of the building facing Old Hopewell Road, she never had any signage on the facia. She proposed 67 square feet of signage on the Old Hopewell side. Fifty square feet is allowed. Mr. Lehigh asked about signage on Old Route 9. Mrs. Greer-Schunzel said the only signage she has there is an illuminated parts & service sign and an inspection sign. She said she has no name recognition on that side of the road. Mr. Fanuele asked about the signage on Old Hopewell Road. Mrs. Greer-Schunzel explained she proposed 67 square feet of signage. She said it would end up 67 sq. ft. or smaller. She will use a different sign company from Plasti Line because Plasti Line can not make the sign without the logo. She is not sure what the actual height and width of the signs will be, but the two signs will be exactly the same size and they will be under 67 sq. ft. Unfortunately, the signs on Old Hopewell Road will be smaller than the signs on Route 9. In order to have all the signs the same size, she would have to ask for a much larger variance. Mr. Prager asked what the 145 square feet of existing signage consisted of. Mrs. Greer-Schunzel stated it consisted of Greer Toyota, LTD, and the old Subaru sign. Mr. Prager asked if she had a variance for those signs. Mrs. Greer-Schunzel said the signs were always on the building since she can remember. Subaru came along in 1978, and they normally obtain their own approval for their signs. Mr. Prager asked Mrs. Greer-Schunzel for the letter from Greer mandating a certain size sign. Mrs. Greer-Schunzel stated she didn't bring the letter with her. She said she would give it to Linda before the public hearing. The letter basically said Toyota mandates dealers to put certain signage up assuming the Towns allow it. Mr. Lehigh suggested Mrs. Greer-Schunzel should notify the Building Department to find out if a building permit was ever obtained for the facia. If not, she should get one as soon as possible. Mr. Prager suggested setting the public hearing pending if Mrs. Greer-Schunzel does not need a permit. A public hearing was set for February 10'h. Mr. Warren made a motion for the ZBA to be the Lead Agency. Mr. diPierno seconded the motion. Vote: All present voted aye. `'4r Mr. Lehigh made a motion to close the meeting.
