The Zoning Board of Appeals declared itself Lead Agency for this project on November 25,

Mr. Warren made a motion to reopen the adjourned public hearing.
Mr. Fanuele seconded the motion.

Mr. Prager explained the reason the Board had adjourned the public hearing was because they
wanted to check to see if there were any previous building permits for the two sheds.
Mr. Close submitted a letter dated December 10, 1997, stating the applicants recently applied for
a building permit, No. 97-554 on August 26, 1997, for two sheds. The permit was denied by Mr.
Close because of the offsets not being met. He asked the applicants and then the audience if they
had any new information. Hearing none;
Mr. Lehigh asked if they were still requesting variances for both sheds since one of the sheds is
pretty well shot.
Mr. Prager logged into evidence pictures of the sheds, minutes from the ZBA meeting on Nov.
25', and a letter from Mr. Close dated December 10, 1997. He stated the Findings of Facts. The
appellants' property in its entirety falls within the R-15 district classification. It is located at 6
Barbara Lane in the Town of Wappinger, New York. The appellants are seeking two area
variances of Article IV, Section 420.3. The appellants have owned the property since 1968. The
first shed was installed on the property approximately 1974 and the second shed approximately
1980. The Board held a site inspection on Saturday, December 6, 1997.
Mr. Lehigh made a motion to close the adjourned public hearing.
Mr. Fanuele seconded the motion.
Vote: All present voted aye.
Mr. Prager made a motion to grant the variance for the large shed only. The requested variance
is detrimental to nearby properties. He did not think an undesirable change would occur. There
were other alternative methods available to achieve the benefit they sought. They could move
the sheds to meet the required setbacks. The requested area variance is not substantial. It will
not cause an adverse effect or impact on the physical or environmental condition in the
neighborhood. The alleged difficulty is self-created. The appellants installed the sheds at the
incorrect setback. He requested the larger shed is to be removed before they sell the property.
He clarified that he was only making a motion to grant a variance for the larger shed, but when
they are ready to move, the larger shed is to be removed.

Mr. Prager asked how soon would the appellants have to remove the smaller shed.
Mr. Close said 30 days, by the end of February.
Mrs. Carozza asked if she could move the smaller shed to another location on the property.
Mr. Fanuele said as long as it meets the Zoning Offsets.

Guardian Self -Storage - To discuss expanding Guardian Self -Storage next to Fun Central.
Mrs. Keri Daniels and Mr. Alan Daniels were present.
Mrs. Daniels explained they are proposing to subdivide the Guardian Self -Storage lot and the
vacant abutting lot. They want to decrease the Guardian site (now 7.04 acres to 5.85 acres) and
enlarge the vacant lot on the corner of Route 9 and Scenic Drive (now 3.27 acres to 4.46 acres).
She stated the existing house on the Guardian site would be removed. She explained she would
need variances for building coverage and open space.
Mr. Close stated the Guardian site would be 5.85 acres (254,826 sq. ft.). The existing building
coverage is 57,520 sq. ft. The proposed new building coverage would be an additional 26,400
sq. ft. (giving it a total of 83,920 sq. ft). He said the Ordinance allows 25% building coverage
(63,707 sq. ft.). She would be over 32%, which will require a variance. They will also need a
variance for open space. Twenty-five percent is required and they will be over by 24%. He
explained that they will not need a variance for impervious coverage since 75% is allowed and
they are at 61 %.
Mr. Daniels stated they are proposing to decrease the open space by an additional 8%.
Mrs. Daniels stated they will meet the 75 -foot setback from the road and 10 -foot side setback for
both lots.
MIXED DISCUSSION - Regarding access from Scenic Drive, fence and Mr. Close's
calculations.

Mr. Prager stated Mrs. Daniels came before the ZBA just to see if it is something the Board
would look favorably at. He polled the Board.
The Board said they have no problem with the project conceptually.
Mr. Close stated he will send a letter to the Planning Board to that effect. He said Mrs. Daniels
next step is to go back to the Planning Board.
Mr. Lehigh made a motion to adjourn the meeting.
Mr. Warren seconded the motion.
