Mrs. Nguyen, Secretary to the Zoning Board of Appeals , YLAN,%Iri6 '80ARD SUMMARIZED ZONING 90ARD Of APPEkLI Minutes to be approved: November 24, 1998 -- Tabled Al February'' -2-3, 1999 Discussion: Eckerd Retail Drug Store -- Set Public Hearing for February 23, 1999 MINUTES Mr. Prager requested the November 24, 1998, minutes be tabled until February 23, 1999. DISCUSSION Eckerd Retail Drug Store - To discuss Appeal No. 99-7000 regarding a side yard setback variance for property located on the corner of Route 9 and New Hackensack Road in the Town of Wappinger. Ms. Van Tuyl, Esq. and Mr. DePuy, PE, were present. Mr. DePuy, PE, explained that the original proposal met the Zoning requirements. However, due the Planning Board and the DOT's request for them to make room for a possible future lane, they had to shift the whole site back. Even though this parcel is on a corner lot, the side yard has been interpreted as a front yard which has a 75 foot requirement. They are proposing only 54.53 feet from the property line. Ms. Van Tuyl, Esq. clarified it would be called a side yard, but it is required to be equivalent of the front yard. The Planning Board was interested in providing the possibility of a third lane going south and also sidewalks and a bike lane. That is what has prompted them to shift the site, thus requiring a variance. The Planning Board has indicated support of the variance. MIXED DISCUSSION REGARDING ACCESS TO THE SITE, SHAPE OF THE PROPOSED BUILDING, AND PARKING. The Fire Prevention Bureau joined the meeting. Ms. Van Tuyl, Esq. stated the Planning Board did a Lead Agency circulation, but they did not circulate it to the ZBA. At that time they did not realize they needed a variance. She had suggested at the end of her application letter for the Board to grant the variance conditioned upon the adoption of the Neg. Dec. by the Planning Board. Mr. Prager agreed that if they grant the variance, it would be conditional. He set the public hearing for February 23, 1999. Mr. Warren made a motion to adjourn the meeting.
