PUBLIC HEARING Town Hall 20 Middlebush Road Wappingers Falls, NY NUO' Anneal No. 1253 - At the request of Chris & Sharon Ryder who are seeking two area variance of Article IV, Section 420.3 - Schedule of Dimensional Regulations - Whereas a 20 -foot side yard setback is required, the appellants are proposing to construct an addition (20'6" X 36') off the front of the existing house 14 feet from both sides of the side yard, thus two 6 -foot side yard variances are required for property located at 16 Lake Drive and is identified as Tax Grid No. 19- 6056-01-284765-00 in the Town of Wappinger. The Zoning Board of Appeals declared itself Lead Agency for this project on November 12, 1997. DISCUSSION 1. Sherilyn & Anthony Carozza - To discuss Appeal No. 1255 requesting two side yard variances for two existing sheds on property located at 6 Barbara Lane in the Town of Wappinger. 2. Greer Nine Realty Corp. - To discuss Appeal No. 1256 requesting a sign variance to exceed 100 square feet on the front of the building and half that on the side. The property is located at 1420 Route 9 in the Town of Wappinger. Mr. Lehigh made a motion to approve the November 12"' minutes. Mr. Warren seconded the motion. Vote: All present voted aye. Mr. Warren seconded the motion. Vote: All present voted aye. Mrs. Nguyen stated all the mailings were in order. Mr. Friedenberg, 18 Lake Drive, was concerned about drainage from the retaining wall. Mr. Prager suggested a swale so no additional water could go onto the abutting neighbors' property. Mr. Ryder agreed to build a swale and to divert any runoff away from his neighbors' property. Mr. Lehigh made a motion for a Negative Dec. Mr. Warren seconded the motion. Vote: All present voted aye. Mr. Lehigh made a motion to close the public hearing. Mr. Fanuele seconded the motion. Vote: All present voted aye. Mr. Lehigh made a motion to grant 2 six foot side yard variances. He stated the requested variances will not produce an undesirable change in the character of the neighborhood. No, substantial detriment will be created to nearby properties. There were no other feasible methods for the applicants to pursue to achieve the benefit they sought other than the requested variances since they could not build into the hill. They had to build off the front of the house. The requested area variances were not substantial. The proposed variances will not have an adverse effect or impact on the physical or environmental condition in the neighborhood or district. The alleged difficulty is self-created since they could have reduced the size of the addition. Therefore, the variances were granted. Mr. Warren seconded the motion. OR Town of Wappinger Zoning Board of Appeals Minutes - November 25, 1997 Page 3 DISCUSSION Sherilyn & Anthony Carozza - To discuss Appeal No. 1255 requesting two side yard variances for two existing sheds on property located at 6 Barbara Lane in the Town of Wappinger. Mrs. Carozza explained they are requesting two variances for two existing sheds because they plan to sell their property. Mr. Carozza stated they bought the house in 1968. One shed has been on the property since 1974 and the other since the 80's. Mrs. Carozza present some photo's of the two sheds. Mr. Fanuele asked since they will be moving, why do they need the sheds. Mrs. Carozza stated the new owners may need them. Mr. Lehigh asked if their neighbors have any problems with the sheds. Mr. Carozza said none of them have every said anything. Mr. Prager set a site inspection for Saturday, December 6, 1997, at 9:00. Mr. Warren made a motion for the ZBA to be Lead Agency. Mr. Fanuele seconded the motion. Vote: All present voted aye. Mr. Prager set the public hearing for December 9'. 2. Greer Nine Realty Corp. - To discuss Appeal No. 1256 requesting two sign variances. One to exceed 100 square feet on the front of the building (Route 9) and the second variance to exceed 50 square feet of signage on the side of the building (Old Hopewell Road). The property is located at 1420 Route 9 in the Town of Wappinger. Mrs. Schunzel stated she would like to have all the signage that she proposed on her application, however, she realized she would have to minimize her request. She suggested removing the existing Greer Toyota sign (70 sq. ft.) from the front of the building on Route 9. She presented a revised plan showing the dimensions of the signs and the logos. She adamantly wanted to keep the existing Subaru sign on Route 9 due to her dealership agreement with Subaru. She proposed a Toyota sign with a logo (56.07 sq. ft.), a Greer sign with a logo (20 sq. ft.), and the existing Subaru sign with a logo (34.34 sq. ft.) on the front of the building on Route 9. Her total signage on Route 9 would be 104.34 sq. ft., whereas 100 sq. ft. is allowed. Also, she proposed signage for the side of the building on Old Hopewell Road. She proposed a Subaru sign with a logo (30 sq. ft.) and a Toyota sign with a logo (34 sq. ft.), giving her a total of 64 sq. ft. on Old Hopewell Road, whereas 50 sq. ft. is allowed. Mr. Lehigh made a motion for the ZBA to be Lead Agency. Mr. Warren seconded the motion. Vote: All present voted aye. Mr. Prager suggested the Board should wait to vote on a Negative Dec, then he set the public hearing for December 9"'. Also, a site inspection was set for Friday, December 6, 1997.
