Dutchess County Planning Federation - An informal workshop on Cellular Communication Towers will be held on Tuesday, September 23, 1997, from 7:00 p.m. to `'A' 9:30 p.m. at the Farm and Home Center on Route 44 in Millbrook, NY. 2. New York Planning Federation 1997 Annual Instritute Conference - To be held on Sunday, October 26, 1997, through Wednesday, October 28, 1997, at Saratoga Springs, NY. 3. CJ Mr. Prager: The first item of business tonight is the approval of the August 26, 1997, minutes. Can I have a motion please? Mr. Warren: I make a motion. Mr. Fanuele: Second. Vote: All present voted aye. Mr. Prager: The next item of business on tonight's agenda is to discuss Appeal No. 1248 - Joseph & Jill DiPalma - requesting a rear yard variance for an accessory building on property located at 1 Doyle Drive in the Town of Wappinger. What we will do tonight is basically a fact finding for any information that we might need and you would supply for the public hearing. Mr. DiPalma: I am Joseph A. DiPalma. Mr. Prager: Tell us a little bit about what you want, and why. Mr. DiPalma: I have at this point a 10 X 10 shed that is completely full from the floor to the *4W roof. I have quite a few items under my deck in the rear of the house. I would like to put up a 12 X 24 shed so I can keep everything in it and still be useable and accessible to everything instead of having to empty it out every time I need to get something. I don't know why it doesn't meet the Zoning Regulations. When the house was built it was before Zoning. Mr. Prager: Basically, we are talking about an accessory building, that is why. Mr. DiPalma: My house doesn't even meet the setback. Mr. Prager: That is the primary building, right? Mr. Close: The primary building was before Zoning. Mr. Fanuele: It was before the current Zoning and not before Zoning. Mr. DiPalma: That in itself gives me limited area to work with in the back yard. The rest of the backyard is taken up by trees, a hill, and a deck that is added to the house. Mr. Lehigh: You don't have it in the drawing you give us, the deck. Mr. DiPalma: I may not have. . Mr. Prager: If I could just interrupt too, Mr. Lehigh mentioned the drawing. I am a little '`" confused I guess. The plot plan doesn't really go along with the survey as far as I can see. Am I right? Which is right? Now, the plot plan looks to me like the shed is over in the left rear of the house. Mr. DiPalma: That is not the proposed shed. Mr. Lehigh: You already have a shed then? Mr. DiPalma: Yes. Mr. Prager: The wooden shed is 10 X 10. Are you going to take that down? Mr. DiPalma: No. Mr. Prager: So, you will have a 12 X 24 on the left side. Mr. DiPalma: On the right side of the house, we just put a pool in. It is not on the drawings because we just applied for it and got approval. It was installed about a week ago. So, there is no area on the right side where I could put the building. Also, I am going to keep a snow blower in there. It is quite difficult, especially last year, I found out keeping it in the other shed is more trouble getting to it than it was to use it in a big snowstorm. low Mr. Prager: How many things do you have to put into this shed? That is a good size shed. Mr. DiPalma: Quite a bit. I have a show car that I keep in my garage and I have spare parts for that. I have an engine hoist that I use for that. I have a generator. Approximately, 20 chairs for my back porch. Mr. Prager: What size mower? Mr. DiPalma: Fifty-two inch - Gravely Lawnmower. Which right now I have to leave outside because I have no where to put it. I have a snow blower, a seeder and all the other various things. I am sure I could make my wife happy and make more room in the basement too. Mr. Prager: Do you use any of this for a commercial business or just for your own property? Mr. DiPalma: No, just for my own property. I have two jobs so you do not have to worry about me working anywhere else on the side. Mr. Lehigh: Just where is that pool that is supposed to be in here. Mr. DiPalma: That was applied for on the same day as the shed. That is why it is not on there. It is on the right side of the house looking from the front. Mr. Prager: Exactly on the right side? Mr. DiPalma: Yes. Mr. Prager: Is it aboveground? Mr. DiPalma: Yes. Mr. Fanuele: How high is the deck off the ground? Mr. DiPalma: The deck is approximately ... There is a bit of a hill so it goes from probably about 5 feet to 6 feet at different points. Mr. Prager: Do you have a drawing of the proposed shed and what it will look like? Mr. DiPalma: No, I was going to buy one completely assembled. They deliver it. Mr. Prager: Can you get a picture of it or something for us? Maybe you can put that down to bring that to the next meeting? Mr. DiPalma: Yes. Mr. Lehigh: I think we need to see the pool. I think we should go and look. n" Mr. Prager: Yes, I definitely would like to see us have a site inspection. Mr. Fanuele: You had to cut some trees down to put the pool in. Mr. DiPalma: No, I didn't cut anything down. If I have to, I can do that. Mr. Prager: I will tell you right now, you have got a 70 percent variance. That is really big. We will take a look at it. SITE INSPECTION - Set for Saturday, September 13, 1997, at 9:00 AM. Mrs. DiPalma: This Saturday? Do we have to be there? Mr. Lehigh: No, we are not going to discuss anything. We are just going to come and look at it. Mr. Close: Do you want Joe to stake it out? Mr. Prager: Yes, please stake it out exactly where you are going to have it. If you can, not only stake it out, but put some string around it so it gives us a little more feeling for the building. Basically, at the next meeting bring a drawing or a picture of the shed. How high would it be? ,*.. Mr. DiPalma: I believe it is 10 feet. Mr. Prager: Put dimensions on whatever you bring us. Mr. Fanuele: (Too low to transcribe.) Mr. DiPalma: No, I believe it is barn style. I have the dimensions at home. Mr. Lehigh: Do you have a brochure on it? Mr. DiPalma: Yes. Mr. Prager: Can I have a motion for the ZBA to be Lead Agency? Mr. diPierno: So moved. Mr. Warren: Second. Vote: All present voted aye. Normally it would be on a Tuesday, but we have a class to go to on Tuesday. I think that is all we will need. Anybody else have anything? Mr. DiPalma: Will that be at the same time? Mr. Prager: Yes, 7:30 PM. Now, you know how to get everything in the paper? You have to talk to Don and Linda. Mrs. DiPalma: I will talk to Linda. Mr. Prager: We have some things here to discuss. Mr. Fanuele: I have a question for Don. How many accessory buildings can you put on a piece of property? Mr. Close: We did check the square footage of what you're allowed on the property. They haven't got that. They are all right there. You have to keep a minimum of 25% green, I think it is. Mr. Fanuele: What is your interpretation of the number he can put on the ..? Mr. Close: Until they meet the maximum coverage. Does anybody have their book with you? Mr. Lehigh: Yes. Mr. Close: If you look in there where the have. DISCUSSION In the back it tells you how much coverage you can Mr. Lehigh: In R-20 they are only allowed 15% coverage. Maximum lot coverage 15. Mr. Close: He doesn't have that. Mr. Fanuele: The question is, do you interpret that he can put as many as he wants as long as he stays under the 15? Mr. Close: Yes, that is the way I read it. Mr. Lehigh: You really should be giving the interpretation, not him. Mr. Fanuele: I just wanted to ask what his opinion is. If we feel something different ... Nobody asked for an interpretation. A lot of people enclose their porch to store stuff under it. Mr. Lehigh: He has stuff under there now. Mr. Fanuele: He wants to take it out. Then, what is he going to do with it? Mr. Lehigh: Put it in his shed. Mr. Fanuele: He wouldn't have to if he enclosed the porch. MISCELLANEOUS 1. Dutchess County Planning Federation - An informal workshop on Cellular Communication Towers will be held on Tuesday, September 23, 1997, from 7:00 p.m. to 9:30 p.m. at the Farm and Home Center on Route 44 in Millbrook, NY. All of the Board, except Mr. Warren plan to attend. Mr. Fanuele stated he will pay at the door. 2. New York Plannin Federation 1997 Annual Institute Conference - To be held on Sunday, October 26, 1997, through Wednesday, October 28, 1997, at Saratoga Springs, NY. Mr. Lehigh plans to attend. He will let Mrs. Nguyen know definitely the next day. 3. Natural Resource Inventory Course -Fall, 1997 -Six sessions to be held on October 1, 8, 15, 29 and November 12 & 19 at the Dutchess County Farm and Home Center, Route 44, Millbrook, NY. The Board was not interested in attending. Mrs. Nguyen said she will submit the paperwork to the Town Board. Mr. Prager: Any other business before the Board? I will entertain a motion to adjourn.
