Recycle Center Issues - Beale Supervisor Colsey opened the discussion at 7:01 PM. Councilman Beale explained that there was an issue with a Poughkeepsie resident that was erroneously given a Recycle Center permit. The person attempted to use the facility and was told by the Highway Superintendent, Graham Foster, that they were not residents and, therefore, not entitled to use the site. Mr. Foster explained that the person had two permits, one for each of their cars. He went on to say that the error is that the pen -nit was issued with an Edgehill Drive address, but the resident actually resides at Edgehill Road. Edgehill Road is in Poughkeepsie. Councilman Beale asked what the solution to the problem is. He recommended that the Town send the individual a nice letter explaining that the permit was issued in error and asking that the individual return the permit. He made a motion directing the Town Clerk to do so. The motion was seconded by Councilman Bettina and passed unanimously. Public Portion Motion To: suspend the Rules for public input RESULT: ADOPTED [UNANIMOUS] MOVER: Vincent Bettina, Councilman SECONDER: William Beale, Councilman AYES: Colsey, Beale, Bettina, McCarthy, Paoloni Public comments Phil DiNonno was the first resident to speak. He noted that there was a Resolution on the Agenda pertaining to the Director of Code Enforcement. He asked if that was still on, or if it has been pulled. Councilwoman McCarthy answered that she had asked for it to be pulled and now she is requesting that it be tabled. She explained that she is still waiting on information from Civil Service. Mr. DiNonno replied that he is still going to comment in case it happens to end up back on the Agenda. He commented that it would be a disservice to the Town to eliminate the position of Director of Code Enforcement. Mike Schnorr was the next resident to speak. He asked if it was correct that there is a Resolution to get rid of George Kolb. Supervisor Colsey and Councilman Bettina explained that there is a Resolution to reorganize the department and that the Board is waiting on feedback from Civil Service. Mr. Schnorr noted that he has been dealing with this department for 30 years. He felt that Mr. Kolb was "the best thing since sliced bread". Councilwoman McCarthy asked Mr. Schnorr to explain why. Mr. Schnorr gave his reasons. The next resident to speak was Bill Neave. He seconded Mr. Schnorr's comments. Supervisor Colsey explained that these are just comments. The Board is not making any motions and the Resolution is being tabled. Doug Ginsberg spoke next. He has taken out several permits over the years. He feels that the department is very professional and courteous and is run well. Councilwoman McCarthy asked how the residents decided to come to the Town Board Meeting. The residents answered that the notice was in the paper. The Councilwoman then asked if they had any knowledge that this Resolution was on the Agenda. Mr. DiNonno answered that he did know that the Resolution was on the Agenda. Mr. Kolb asked to comment. Councilwoman McCarthy explained that she had requested an amount of information from Civil Service and expected to have that information, as she had requested it December 17`''. When she had not received the information by Sunday, January 4`h, she asked that the Resolution be taken off of the Agenda. She feels that it is unfair to have discussion about positions being restructured within the department, even the way that she had laid them out, because they didn't have the information from Civil Service. She went on to say that it is unfair to talk about the positions, and the cascade of what happens to the people that hold those positions, if they didn't have the information from Civil Service. She claimed that some information was provided to the Supervisor prior to Christmas, but it was not passed on to her. Rather than having the issue turn into a "me against you" argument, she respectfully requested that this be tabled until she had all of her information, which she feels is a very responsible thing. She is surprised to find that it wasn't taken off the Agenda, because now they have to go through the whole formality of tabling or withdrawing the Resolution officially. Councilman Beale answered that the Councilwoman can't exercise motives like this and expect people not to come and question her. Councilwoman McCarthy replied that there is no motive. Councilman Beale felt that the Councilwoman was again attempting to "head -hunt". Councilwoman McCarthy disagreed. Councilman Beale commented that this is not only unethical, but is also questionably illegal. Councilwoman McCarthy replied that there is no "head-hunting". Councilman Beale noted that the Councilwoman is attempting to eliminate George Kolb, and the wrong employee from the Department, in the Resolution that she presented to the Town Clerk without presenting it to the other Board Members. Councilwoman McCarthy claimed that she did send it to the other Board Members. Councilman Beale replied that she did not. He explained that she emailed it to the Town Clerk twice, and if he hadn't "replied all", with the original message below it, he wouldn't even have known about this until the packets were delivered on Friday. He doesn't remember any discussions regarding the elimination of George Kolb, or any inspector, for that matter. He also asked when it was that they decided to make the Zoning Administrator the Department Head. He felt that the Resolution is inconsistent with the direction that they received from Dutchess County Personnel. He went on to say that he isn't going to let his fellow Town Board colleague further deteriorate the morale at Town Hall by submitting a "back -door, political Resolution" in some sort of attempt to further an agenda that he has no idea about. He stated that he had been at 100% of the Town Board Meetings since July of 2005, and he doesn't recall ever discussing the elimination of George Kolb. Councilwoman McCarthy explained that she was mandated to stay at work, as a Registered Nurse. She noted that Councilman Beale throws that out there as though she is being irresponsible by not attending meetings with Civil Service. She went on to say that the Board has had repeated discussions about reorganizing the department, not only because of budgetary issues, but also because of efficiency issues. This Resolution was only one idea of how to restructure the department. She then commended the Councilman on his wonderful performance. Supervisor Colsey attempted to gain control of the Meeting, by asking for a motion to reinstate the Rules. George Kolb respectfully noted that he had asked to make a comment. The Supervisor agreed to let Mr. Kolb speak and asked him to keep it respectful. Councilwoman McCarthy stated that the Supervisor let Councilman Beale go on and on and wouldn't even let her answer. Councilman Paoloni agreed. Arguing continued. Supervisor Colsey again asked for a motion to reinstate the Rules. The motion was made by both Councilwoman McCarthy and Councilman Bettina. There was no second, but it passed unanimously. Supervisor Colsey apologized for not letting Mr. Kolb speak. A resident asked if there was going to be a public portion. Supervisor Colsey replied that the public portion has been closed because it got out of control. RESOLUTION: 2009-5 Resolution Authorizing the Submission of the Supervisor's Annual Report to the State Comptroller WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company, and cause a certified copy of such report to be published in the official newspaper, and WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. RESOLUTION: 2009-8 Resolution Establishing Petty Cash Funds for Various Offices WHEREAS, the Justice Court has had an increase in its work load and has the need of having to make change on a daily basis; and WHEREAS, the Town Clerk of the Town of Wappinger has numerous requests for expenditures of small amounts of cash for postage, supplies, making change on a daily basis, and various miscellaneous items, for various departments of the Town of Wappinger; and WHEREAS, a Petty Cash fund has been established for the Receiver of Taxes, pursuant to the provision of Section 64, paragraph 1-a of Town Law, which shall be reimbursed to the Supervisor for advances at the close of each fiscal year; and Town of Wappinger Page 6 Printed 1/9/2009 Reorganization Meeting Minutes January 5, 2009 WHEREAS, the Recreation Committee has numerous requests for expenditures of small amounts of cash for supplies and miscellaneous items and reimbursement of small expenditures to various areas of the Recreation program and Maintenance work for the Town of Wappinger. There is a waterway uphill from his property that is flooding onto his property and causing a tremendous amount of erosion.
