A. Recycle Center Issues - Beale
Supervisor Colsey opened the discussion at 7:01 PM. Councilman Beale explained that
there was an issue with a Poughkeepsie resident that was erroneously given a Recycle Center
permit. The person attempted to use the facility and was told by the Highway Superintendent,
Graham Foster, that they were not residents and, therefore, not entitled to use the site.
Mr. Foster explained that the person had two permits, one for each of their cars. He went
on to say that the error is that the pen -nit was issued with an Edgehill Drive address, but the
resident actually resides at Edgehill Road. Edgehill Road is in Poughkeepsie.
Councilman Beale asked what the solution to the problem is. He recommended that the
Town send the individual a nice letter explaining that the permit was issued in error and asking
that the individual return the permit. He made a motion directing the Town Clerk to do so. The
motion was seconded by Councilman Bettina and passed unanimously.

Public comments
Phil DiNonno was the first resident to speak. He noted that there was a Resolution on the
Agenda pertaining to the Director of Code Enforcement. He asked if that was still on, or if it has
been pulled. Councilwoman McCarthy answered that she had asked for it to be pulled and now
she is requesting that it be tabled. She explained that she is still waiting on information from
Civil Service. Mr. DiNonno replied that he is still going to comment in case it happens to end up
back on the Agenda. He commented that it would be a disservice to the Town to eliminate the
position of Director of Code Enforcement.
Mike Schnorr was the next resident to speak. He asked if it was correct that there is a
Resolution to get rid of George Kolb. Supervisor Colsey and Councilman Bettina explained that
there is a Resolution to reorganize the department and that the Board is waiting on feedback from
Civil Service. Mr. Schnorr noted that he has been dealing with this department for 30 years. He
felt that Mr. Kolb was "the best thing since sliced bread". Councilwoman McCarthy asked Mr.
Schnorr to explain why. Mr. Schnorr gave his reasons.
The next resident to speak was Bill Neave. He seconded Mr. Schnorr's comments.
Supervisor Colsey explained that these are just comments. The Board is not making any
motions and the Resolution is being tabled.
Doug Ginsberg spoke next. He has taken out several permits over the years. He feels
that the department is very professional and courteous and is run well. Councilwoman McCarthy
asked how the residents decided to come to the Town Board Meeting. The residents answered
that the notice was in the paper. The Councilwoman then asked if they had any knowledge that
this Resolution was on the Agenda. Mr. DiNonno answered that he did know that the Resolution
was on the Agenda. Mr. Kolb asked to comment. Councilwoman McCarthy explained that she
had requested an amount of information from Civil Service and expected to have that
information, as she had requested it December 17`''. When she had not received the information
by Sunday, January 4`h, she asked that the Resolution be taken off of the Agenda. She feels that
it is unfair to have discussion about positions being restructured within the department, even the
way that she had laid them out, because they didn't have the information from Civil Service. She
went on to say that it is unfair to talk about the positions, and the cascade of what happens to the
people that hold those positions, if they didn't have the information from Civil Service. She
claimed that some information was provided to the Supervisor prior to Christmas, but it was not
passed on to her. Rather than having the issue turn into a "me against you" argument, she
respectfully requested that this be tabled until she had all of her information, which she feels is a
very responsible thing. She is surprised to find that it wasn't taken off the Agenda, because now
they have to go through the whole formality of tabling or withdrawing the Resolution officially.
Councilman Beale answered that the Councilwoman can't exercise motives like this and
expect people not to come and question her. Councilwoman McCarthy replied that there is no
motive. Councilman Beale felt that the Councilwoman was again attempting to "head -hunt".
Councilwoman McCarthy disagreed. Councilman Beale commented that this is not only
unethical, but is also questionably illegal. Councilwoman McCarthy replied that there is no
"head-hunting". Councilman Beale noted that the Councilwoman is attempting to eliminate
George Kolb, and the wrong employee from the Department, in the Resolution that she presented
to the Town Clerk without presenting it to the other Board Members. Councilwoman McCarthy
claimed that she did send it to the other Board Members. Councilman Beale replied that she did
not. He explained that she emailed it to the Town Clerk twice, and if he hadn't "replied all", with
the original message below it, he wouldn't even have known about this until the packets were
delivered on Friday. He doesn't remember any discussions regarding the elimination of George
Kolb, or any inspector, for that matter. He also asked when it was that they decided to make the
Zoning Administrator the Department Head. He felt that the Resolution is inconsistent with the
direction that they received from Dutchess County Personnel. He went on to say that he isn't
going to let his fellow Town Board colleague further deteriorate the morale at Town Hall by
submitting a "back -door, political Resolution" in some sort of attempt to further an agenda that
he has no idea about. He stated that he had been at 100% of the Town Board Meetings since
July of 2005, and he doesn't recall ever discussing the elimination of George Kolb. He asked

when the discussions took place.
Councilwoman McCarthy explained that she was mandated to stay at work, as a
Registered Nurse. She noted that Councilman Beale throws that out there as though she is being
irresponsible by not attending meetings with Civil Service. She went on to say that the Board
has had repeated discussions about reorganizing the department, not only because of budgetary
issues, but also because of efficiency issues. This Resolution was only one idea of how to
restructure the department. She then commended the Councilman on his wonderful
performance. Supervisor Colsey attempted to gain control of the Meeting, by asking for a
motion to reinstate the Rules.
George Kolb respectfully noted that he had asked to make a comment. The Supervisor
agreed to let Mr. Kolb speak and asked him to keep it respectful. Councilwoman McCarthy
stated that the Supervisor let Councilman Beale go on and on and wouldn't even let her answer.
Councilman Paoloni agreed. Arguing continued. Supervisor Colsey again asked for a motion to
reinstate the Rules. The motion was made by both Councilwoman McCarthy and Councilman
Bettina. There was no second, but it passed unanimously. Supervisor Colsey apologized for not
letting Mr. Kolb speak.
A resident asked if there was going to be a public portion. Supervisor Colsey replied that
the public portion has been closed because it got out of control.

Resolution Establishing Purchasing Procedures for the Town of Wappinger
WHEREAS, pursuant to Town Law, the Town Board adopts a budget for the ensuing
year; and
WHEREAS, the Town Board, on November 19, 2008, adopted the budget for the 2009
fiscal year
NOW, THEREFORE, BE IT RESOLVED, that subject to the provisions of Sec 117 of

the Town Law, where provisions had been made in the annual budget for expenditures for the
purchase of equipment, supplies or goods, further approval by the Town Board to authorize the

BE IT FURTHER RESOLVED, that Town Board permission to seek bids on the
purchase of equipment, supplies or goods pursuant to the Town Procurement Policy will not be
required if any item is purchased through State bid or County bid.

Resolution Reaffirming the Adoption of the Rules of the Town Board of the Town of
Wappinger
BE IT RESOLVED, to ensure the orderly conduct of Town Board business, the Town
Board wishes to re -affirm the adoption, as set forth in Resolution No. 2006-01, of a set of rules
entitled "Rules of the Town Board of the Town of Wappinger" governing the Town Board.
BE IT FURTHER RESOLVED, that the Town Board of the Town of Wappinger
hereby re -affirms the adoption of the "Rules of the Town Board of the Town of Wappinger," as
the governing rules of the Town Board.

Resolution Authorizing Attendance and Designating a Representative and Alternate to the
Association of Towns Annual Meeting
WHEREAS, the Town Board of the Town of Wappinger has authorized members of the
Town Board, Planning Board, Zoning Board of Appeals, Town Clerk, Town Justices, Town
Attorney and employees of the Town of Wappinger to attend the 2009 Association of Towns
Annual Meeting at a total budgeted amount not to exceed Five Thousand Dollars ($5,000.00);
and
WHEREAS, the Town Board of the Town of Wappinger has determined the purpose of

attendance to be primarily educational, shall require all attendees to attend a minimum of four (4)
hours of daily educational seminars for the purposes of reimbursement expenses; and

documented reimbursement expenses limited to the cost of public transportation, tuition and
meals not to exceed Twenty -Five Dollars ($25.00) expended for each day of attendance; and,
WHEREAS, the 2009 Association of Towns Annual Meeting shall hold its annual
business meeting for the adoption of various resolutions of interest to its members and requires
the fonnal appointment of a Town representative or alternate representative in attendance at such
function.
NOW, THEREFORE, BE IT RESOLVED, that Christopher Colsey, Town Supervisor,
is hereby appointed as the Town of Wappinger Representative to the 2009 Association of Towns
Annual Meeting and William H. Beale is hereby designated as the Alternate Town of Wappinger
Representative to the 2009 Association of Towns Annual Meeting.
BE IT FURTHER RESOLVED, that all attendees of the 2009 Association of Towns
Annual Meeting shall submit their expenses through voucher for consideration of reimbursement
by the Town Board.

RESOLUTION: 2009-5
Resolution Authorizing the Submission of the Supervisor's Annual Report to the State
Comptroller
WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the Supervisor
of each Town prepare and file with the Town Clerk within 30 days after the expiration of each
fiscal year an annual financial report accounting for all monies received and disbursed by him,
together with the certificates or certificate of the bank or trust company, and cause a certified
copy of such report to be published in the official newspaper, and
WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of
Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the
Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State
Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall
cause a summary of such report to be published within 10 days after receipt thereof in a form
approved by the State Comptroller in the official newspaper.
NOW, THEREFORE, BE IT RESOLVED, that in lieu of preparing the report required

Citizen's Bank, TD Bank North, Mahopac Bank and JP Morgan Chase, each being a banking
institution maintaining banking rooms and offices in Dutchess County, New York, be and they
each hereby are severally designated as depositories of the monies of this Town; and

Resolution Authorizing the Use of a Mechanical Check Signing Device
BE IT RESOLVED, that the voucher order checks of the Town of Wappinger may be
signed with a facsimile signature of the Supervisor of the Town, as reproduced by a mechanical
check -signing device or machine, provided that the safeguards specified by the manufacturer and
inherent in the operations of such device are properly observed; and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be filed with all
banking institutions which are depositories of the monies and funds of the Town of Wappinger,
for the purpose of indicating authority for the use of such facsimile signature; and
BE IT FURTHER RESOLVED, that the Supervisor of the Town of Wappinger be and
is hereby authorized and empowered to take all steps which may be necessary and proper to

RESOLUTION: 2009-8
Resolution Establishing Petty Cash Funds for Various Offices
WHEREAS, the Justice Court has had an increase in its work load and has the need of
having to make change on a daily basis; and
WHEREAS, the Town Clerk of the Town of Wappinger has numerous requests for
expenditures of small amounts of cash for postage, supplies, making change on a daily basis, and
various miscellaneous items, for various departments of the Town of Wappinger; and
WHEREAS, a Petty Cash fund has been established for the Receiver of Taxes, pursuant

amounts of cash for supplies and miscellaneous items and reimbursement of small expenditures
to various areas of the Recreation program and Maintenance work for the Town of Wappinger.
NOW, THEREFORE, BE IT RESOLVED, that the Town Justice Court, the Town
Clerk, the Receiver of Taxes and the Recreation Committee are hereby authorized and directed
to establish a Petty Cash Fund, in the sum not to exceed Two Hundred Dollars ($200.00) for
each department, for the use of said Justice Court, Town Clerk, Receiver of Taxes, and the
Recreation Committee, as provided by Paragraph 1-a of Section 64 of Town Law.

Resolution to Adjust Town of Wappinger Mileage Reimbursement Rates for 2009
WHEREAS, the Town of Wappinger regularly compensates employees for the use of
their personal vehicles, in the absence of an available Town owned vehicle, for activities
consistent within the scope of their employment on a reimbursement basis; and
WHEREAS, the Town Board adjusted the allowable reimbursement rate to 50.5 cents
per mile for business miles driven through Resolution 2008-223, as adopted on July 23, 2008;
and
WHEREAS, the Internal Revenue Service had adjusted the allowable reimbursement
rate to 58.5 cents per anile for business miles driven, as referenced in IRS Bulletin IR -2008-82
for the period starting July 1, 2008, through Dec. 31, 2008; and
WHEREAS, the Internal Revenue Service has adjusted the allowable reimbursement rate
to 55 cents per mile for business miles driven, as referenced in IRS Bulletin IR -2008-131, for the
period starting on Jan. 1, 2009.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes the
allowable mileage reimbursement rate of 55 cents per mile for business miles driven.

Resolution Naming a Private Road in the Barry Subdivision
WHEREAS, there is a private road located in the Barry Subdivision, 2486 Route 9D, in
the Town of Wappinger without an authorized name; and
WHEREAS, it is important to establish a name for this road in order to ensure an
efficient process for emergency response personnel; and
WHEREAS, the Applicant through his engineer has proposed the name of "Laurens
Way" for this private road; and
WHEREAS, Jim Tompkins, Program Assistant for Dutchess County Emergency
Response, has determined that there are no conflicts with the name "Laurens Way", as
established through a memo dated December 9, 2009; and
WHEREAS, the Town of Wappinger Fire Prevention Bureau has determined that there
are no conflicts with the name "Laurens Way", as established through a memo dated December
9, 2009.
NOW, THEREFORE, BE IT RESOLVED, the Town Board authorizes fonnally
naming the private road located in the Barry Subdivision, 2486 Route 9D, in the Town of

RESOLUTION: 2009-31
Resolution Authorizing the Town Board to Issue and Approve the Warrant to Pay the
Audited Claims Presented to the Town for 2008
WHEREAS, pursuant to Town Law § 119, which sets forth the procedure for the auditing
of claims and issuance of warrants where there is no Town Comptroller, the Town Board must
audit the claims and issue the warrants for the payment of said claims; and
WHEREAS, since the office of the Town Comptroller had been vacant through July 1,
2008, and the vacancy has been subsequently filled by an Accountant, as deemed qualified
through the competitive Civil Service process, the duties of auditing claims presented to the
Town, and the issuing of warrants authorizing the payment of said claims and bills must be
approved by the Town Board; and
WHEREAS, the Town Board has found that all the claims are just and accurate, has
directed the Town Accounting Department to prepare an abstract of the audited claims,
specifying the number of the claim, the name of the claimant, the amount allowed and the fund
and appropriation account chargeable therewith.
NOW, THEREFORE, BE IT RESOLVED, the Town Board hereby confirms that it
has previously audited and approved all the vouchers as identified in the abstracts as provided to
the Town Board in support of this Resolution as follows:
1. Abstract 21157 with a total of One Hundred Dollars and 00/100 ($100.00);
and
2. Abstract 21158 with a total of One Hundred Seventy Thousand, Three
Hundred Sixty -Nine Dollars and 19/100 ($170,369.19); and

Resolution Authorizing Refund of Unused Escrow for South View Knolls Subdivision
(Account 03-5083)
WHEREAS, on or about December 23, 2003, Hugh Ross filed an application for
approval of a Subdivision known as the "South View Knolls Subdivision", under Application
Number 03-5083; and
WHEREAS, on or about, December 23, 2003, Hugh Ross deposited Seven Thousand,
Five Hundred Dollars and 00/100 ($7,500.00) into an escrow account with the Town of
Wappinger for payment of the fees of the Town's professionals to review the application; and
WHEREAS, additional escrow deposits of Fourteen Thousand, Nine Hundred Ninety -
One Dollars and 30/100 ($14,991.30) and One Thousand, Four Hundred Seventy -Five Dollars
and 00/100 ($1,475.00) were made on July 18, 2007, and October 25, 2007, respectively; and
WHEREAS, the application was approved and the Subdivision Map was signed on
January 4, 2008; and
WHEREAS, all professional fees incurred during the review of the application have
been paid and a balance of Six Thousand, Three Hundred Eighty -Three Dollars and 75/100
($6,383.75) remains in the escrow account, and Hugh Ross has requested a refund of said escrow
balance; and
WHEREAS, the Director of Code Enforcement, Planning Board Secretary and the
Escrow Account Clerk have reviewed the application and the escrow account and have
detennined that a refund is due to Hugh Ross.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set

2. The Town Board hereby authorizes that a payment in the total amount of Six

Resolution Reorganizing Code Enforcement Department
WHEREAS, the national economy and recession have had a negative fiscal impact on all
levels of government across the United States of America; and
WHEREAS, the Town of Wappinger is not immune to the national recession and also
faces a fiscal situation and severe budget constraints due to declining revenues for mortgage
taxes and sales taxes; and

WHEREAS, the Town of Wappinger Town Board adopted the Final 2009 Budget for
the Town of Wappinger which reduces gross expenditures and personnel line items to balance
the budget and address the town's fiscal situation; and
WHEREAS, the Wappinger Town Board, as part of its budget deliberations, determined
that it is necessary to re -organize the various departments under its jurisdiction to operate more
efficiently; and
WHEREAS, the Town Board wishes to clearly define the structure and organization for
the Department of Code Enforcement and to comply with Civil Service Law,
NOW, THEREFORE, BE IT RESOLVED, the Town Board of the Town of
Wappinger does enact as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. Rescind any previous resolution or portion thereof establishing any previous
structure for the "Code Enforcement Department", also known as the "Building
Department".
3. The Town Board hereby establishes that there shall be a department entitled
"Code Enforcement Department".
4. The Code Enforcement Department shall be consisted of (1) Zoning
Administrator, (1) Fire Inspector, (2) Code Enforcement Officers, (1) Planning
Board Secretary, (1) Zoning Board of Appeals Secretary, and (1) Typist.
5. The Town Board hereby abolishes the following titles and positions: (1) Director
of Code Enforcement and (3) Data Entry Clerks.
6. The Town Board hereby designates that the Zoning Administrator shall be the
administrative head of this unit and responsible for all clerical and secretarial
staff, and administration of duties said office.
BE IT FURTHER RESOLVED, the Town Board of the Town of Wappinger does
hereby approve the following appointments:
1. Tatiana Lukianoff is hereby appointed to the fulltime position of Zoning
Administrator.

Councilman Paoloni had invited a resident of his Ward, Dr. Wirzbicki, to come speak to
the Board about a problem he is having on his property. There is a waterway uphill from his
property that is flooding onto his property and causing a tremendous amount of erosion. For as
long as he has owned the property, he's seen approximately one foot of erosion per year, or 8-9
feet of total erosion. Discussion followed. Bob Gray, Engineer to the Town, will be looking into
this issue.

Reorganization Meeting Minutes January 5, 2009
Motion To: confirm the elimination of the title of Code Enforcement Officer and designate
George Kolb Municipal Code Enforcement Official
Councilwoman McCarthy made a motion to confirm the elimination of the title of
"Director of Code Enforcement", held by George Kolb, and hereby designate George Kolb
Municipal Code Enforcement Official, subject to the approval of the Dutchess County
Department of Personnel, in accordance with the Rules and Regulations of the Dutchess County
Department of Personnel, effective immediately. The motion was seconded by Councilman
Paoloni. The motion passed 4-1 with Supervisor Colsey, Councilman Bettina, Councilwoman
McCarthy and Councilman Paoloni voting "AYE" and Councilman Beale voting "NAY".

NOW, THEREFORE, BE IT RESOLVED, that the wages for the following named Town
employees be and the same hereby are fixed and established at the following rates as established in the
Town of Wappinger Budget for the fiscal year 2009 upon their respective anniversary dates:
