'-' Page 2 Minutes of July 9, 2002 PUBLIC HEARING: APPEAL NO. 02-7133 FLAVIA PERRY - Seeking an area variance of Section 240-21 C of District Regulations in an R-40 Zoning District. Whereas a side yard setback of 50 ft. is reGuired for a Corner Lot, aDDlicant is DrODOsinG a side yard setback of 25 ft. to allow Dlacement of storaGe shed, thus reGuestinG a variance of 25 ft. side yard setback. The property is located on 2 Hackensack HeiGhts Rd. and is identified as Tax Grid No. 6257-04-536229 in the Town of Wappinger. Mrs. Perry as you know we were out for a site inspection, but since I wasn't here last month, would you please give a little explanation as to why you need a variance. I need it for storage space for lawn furniture, etc. How large is the shed, 12 x 18? Yes. Do you have any pictures of the shed your proposing to purchase? Yes, there in the car. ( Mrs. Perry instructed her son to retrieve the pictures for the board.) How big is your lot? Did you already pay for this shed and if so can you change the order and make it smaller? I already paid for it in full and had to special order it. When I ordered it the gentleman came over to look and told me everything would be ok and that's why I went ahead and purchased it at that time. Who is this gentleman that you are talking about? Mr. Shed. In fact it's already made and sitting on the lot. (At this time Mrs. Perry proceeded to give the board the pictures ofthe shed.) The shed I purchased does not have a garage door on it. Now why do you need such a large shed? For my patio furniture, swimming pool supplies and I have other things that I would like to store there. I really don't have the space because my basement is a crawl space. I notice that you have another shed on the property. That's a small shed that I like to store things like the pool supplies. Mr. Prager: I know I talked to you the other day when we were over there. Is there any chance that you could take that shed down and put everything in this new shed? Mr. Perry: I think so. Mr. Prager: I would feel better if you did. I would be more inclined then to go with your shed here. Mr. Perry: Ok. Mr. Prager: Is there anyone else in the audience that would like to speak? Mr. Mercatante: My name is Bob Mercatante and I am her neighbor on the side by the existing shed. I would just like to say that the small shed that's there is the only one that would affect me and it doesn't bother me in the least. Everything I have seen them do since they bought that house has been an improvement to the house and the neighborhood and I am very happy with any project that they want to under take. Can the shed be on the other side of the property where the small shed is, in place of it? Then we wouldn't have the road problem. I think, unless it was pushed back Mrs. Perry would have a problem with the side yard setback on that side. I agree with removing the other shed. She's cleaning up the property, so if she cleans it up a bit I don't have a problem with it. I'm not worried with what it looks like, I'm worried that there's a lot of structure there and if you ever had to get in the back of that house with a piece of fire apparatus, you wouldn't be able to do it. I don't believe a negative declaration was done last time. So can I entertain a motion for a neg. dec. at this time? So moved. Second the motion. All present voted aye. Motion to close the Public Hearing? So moved. Second the motion. All present voted aye. Motion to grant the variance with the stipulation that the existing shed go. Second the motion. Mr. Warren: Granted. Mr. diPierno: Granted. Mr. Fanuele: Granted, but I believe the other shed should be allowed to stay if they clean it up. Mr. Prager: Granted, with the stipulation that the other shed go. Your variance has been granted but the only thing is that we request you to remove the existing shed when the new one is in place.
