All present voted aye. AooeaINo.02-7143 Lawrence Travers -Seeking an area variance of Section 240-37 of District Regulations in an R-15 Zoning District. Whereas a front vard setback of 35 feet is reQuired, the applicant is proposing a for front yard setback of 24 feet for the installation of a 7' X 12' front deck with steos, thus reQuestinQ a variance of 11 feet. The property is located at 2 Wendy Road and is identified as Tax Grid No. 6258-01-016684 in the Town of Wappinger. Mr. Lehigh: We don't know what has happened to Mr. Travers, so we will move on to the next discussion. ~ Appeal No. 02-7144 Phil & Vicki Grillot -Seeking an area variance of Section 240-37 of District Regulations in an R- 40 Zoning District. Whereas a frontal:e of 50 feet is required, the applicant is proposing a frontal:e of 20.28 feet, thus requestinl: a variance of 29.72 feet. The property is located on Diddell Road and is identified as Tax Grid No. 6359-02-630650 in the Town of Wappinger. Present: Dan Koehler, Oswald & Gillespie Engineering Mr. Koehler: This parcel is in the R 40-80 zone. The parcel as it exists right now extends into the Town of LaGrange. The deed as it stands extends from this 8.3 acre parcel straight into the parcel in the Town of LaGrange. However there is a Town of LaGrange tax number and there is also a Town of Wappinger tax number. We solicited the Town of Wappinger Planning Department to see if we needed to do a subdivision here and we have a letter from Mrs. Lukianoff that goes on to say it is a pre-existing condition prior to zoning. That the '-" parcel is defined by its own tax map number and it would not need Town of Wappinger Zoning Board of Appeals Page 3 Minutes of October 8, 2002 \..r subdivision. I also believe Barbara has contacted the Town of LaGrange. Mrs. Roberti: I wrote them a letter and sent a copy of the application and asked for their comments before the proposed public hearing on the 22nd of October. Mr. Prager: How much of the land is in LaGrange. Mr. Koehler: The 8.3 acres is in Wappinger. There's about the same in LaGrange, roughly 8.4 acre. There is an existing house on that parcel. Mr. Prager: So it's not subdivided, they just have different tax numbers, correct? Mr. Koehler: Yes as I understand it. The deed does show it as one parcel. Mr. Fanuele: When did the Grillots buy this? Mr. Koehler: In 1992. Mr. Lehigh: I will get in touch with the Town Attorney tomorrow and see what ~ he has to say about this. You will need to give us a little extra time on this. We will have a site visit this Saturday, October 12, 2002. Could you please stake out this property so we can see how it lays out by the driveway. After I speak to the Attorney we will get back in touch with you. Mr. Koehler: Thank you. Mr. Lehigh: In regards to Travers, he will have to remail a new legal notice and we will need to republish the legal in the newspaper. Mr. Prager: When you speak to them tell them we need either a survey map or something that shows the property line. Also the size of the shed, we want to know what the footprint is.
