I notice on the drawing that it looks like it's just that one comer that needs a variance. Is the front of it ok? (Yes.) It would be advantageous for you to find out the number of the front distance for the Public Hearing. I think we should do a site visit. Is Saturday the 30th of November ok with everyone? (Yes, everyone agreed.) Ok, we will be out there around 9:00 a.m. and could you please stake out the garage area and the property line. Appeal No. 02-7150 Wappio2er Falls Toyota-Subaru -Seeking an area variance of Section 240-23 of District Regulations in an HB Zoning District. - Whereas no glare bevond the DrODertv line in excess of 0.05 foot- candles is reauired, the applicant is DroDosina a ranae between .1 and 2.7 foot-candles alona the Route 9 DrODertv line, thus reauestina a variance on the liahtina Dlan as set forth on the Dhotometric maD. The property is located at 1349 Route 9 and is identified as Tax Grid No. 6157-02-585606 in the Town of Wappinger. \.- Present: Phil Hamburger Mr. Hamburger: You have a copy of the schematic of what's on the property now. At this time we have two, 1000 watt lights on the top and two, 400 watt on the bottom. We would like to change that to one, 400 watt at the top and two, 50 watt lights on the bottom. This would reduce the foot-candle by 93 %. We have been working on this for a long time and with an approval from you we would change this right away. Mr. Lehigh: You couldn't bring it down to what the law calls for? Mr. Hamburger: We feel that because of the way the property is set and what we have on it, it is not blacktop, it is gravel and stone. From a safety standpoint anything lower would black out a lot of the area. Weare also putting shields on all of the top lights to help avoid spillage from going over to Route 9. Mr. Lehigh: I realize you need lights to sell cars, but right now it is excessive. Mr. Hamburger: We agree. '-' Town of Wappinger Zoning Board of Appeals Page 5 Minutes of November 26, 2002 \t. Mrs. Lukianoff: I just wanted to say that Mr. Hamburger and his team have worked very hard with Dan Wery fine tuning this and it has reached the point where Dan Wery says this is the closest and the best option. But it still . . reqUIres a vanance. Mr. Lehigh: I would like to see the difference on paper. Mr. Hamburger: I have 6 possibilities that you can look at. It shows the six steps where we kept bringing it down. Mr. Lehigh: I would like to see that in writing for the record. I don't think this requires a visit since there's nothing to see. Mr. Hamburger: We feel very confident that the numbers here will be like night and day from what it is now. Mrs. Lukianoff: I just want to add that this is not the end. This is a step in the process when the Planning reviews the site. Mr. Lehigh: Ok, we will set a Public Hearing for December 10, 2002.
