-Where a rear vard setback of 40 feet is required, the applicant is proposine: a rear vard
setback of 20 feet. to allow for a 12' X 24' pre-fab shed, thus reQuestine: a variance of 20 feet.
The property is located at 7 Bell Air Lane and is identified as Tax Grid No. 6157-02-888867 in
the Town of Wappinger.

I have an old aluminum shed and this past winter I lost it in a
storm. Ijust purchased a new one which is larger, 12' X 24' and
the old one was 12' X 16'. I have myoId documents from 1990
when I put it in and I was told to place the old one 10 feet from
the side. This time I bought a little bigger for storage.
Is the new shed already there?
No, it is on order.
Do you want the new shed in the same place? Can you move the
location at all?
Not really. I have a pool near it and I have a garden in this area.
What about the other side?
I have trees over here and I am on a comer lot too. Explained to
the members how his property is laid out.

If you drive here on Orange Court I'm sure these neighbors
wouldn't want a shed right in the middle of our yard. We are a
comer lot and on the other side it would be in the middle.
I think we should have a site visit on this.
In 1990 there were no restrictions but after 1995 they made a
distinction between a large or small structure. In 1990 it was just
10 feet from the side yard regardless of size. Now if it is over
200 sf then it must be 20 feet from the side line of the property.
It won't be closer to the side. It will start in the same footprint
and come out closer into the yard toward the house.
How do you determine the front of the house?
It is determined where you gain entry. From there the rear and
side is determined. My understanding is the setback will remain
the same.
We will set your site visit for April 1 th and your public hearing
for April 22od.
