The project entails the property line realignment and subdivision of lands owned by Dr. Kablaolli with the adjoining lands owned by the Town of Wappinger (Tall Trees Wellfield). The property line realignment and subdivision is being undertaken to rectify a discrepancy in the origil1l\l subdivision (Filed Map No. 3354) which has resulted in an encroachment of the Kablaoui residenoe onto lands owned by the Town of Wappinger. Under the application, 5,407:1: s.r. will be transferred from the Town of Wappinger to Dr. Kablaoni. The property to be transferred includes no known easements. There are two (2) lots existing, and there will still be two (2) lots after the project is completed. The project would result in a side yard setback of 11.1 feet :t: for the Kablaoui property. Planning/Development/Environmentrrranspor lation Ms. Barbara Roberti Page 2 September 5, 2002 ZOlling Administrator, the Tall Trees subdivision is one of several subdivisions in the Town of Wappinger that were given "setback bonuses" at the time of their creation entitling them to the setback standards of the next lowest zoning district - in this case the R-l 5 district. The properties within the Tall Trees subdivision, therefore, are subject to the IS..foot side yard sotback of the R-I5 district instead of the 20-foot side yard setback of the R-20 district. Thus, the Applicant is seeking a 3.9-foot :i: variance from the required IS-foot side yard setback. This project includes no new structures, improvements, facilities, etc. and as such, is considered to be a minor project. Minimizing loss to the wellhead protection area on the Town of Wappinger (Tall Trees Wellfield) property would appear to be more important than providing the minimum required setback. The Town will not be adversely impacted by a yard that is 3.9 fect smaller than the required 15 feet On the other hand, tfthe full yard was provided, it could invito additional activity within the wellhead protection area. We would ask that the matter be placed on the September 10, 2002 Zoning Board Agenda for the purpose of setting a Public Hearing.
