Dear Mr. Rawald:
Your application # 21703 for a permit to construct (1) a 22' x 28' -4"
addition, with a (2) a 10' x 22' attached deck, a (3) 22' x 25'-4 1/2"
addition and (4) a 6' x 21' front porch with steps is hereby DENIED on
the basis of Section: 240-37 of the Town of Wappinger Zoning Law, which
stipulates:
R-20 ZONNING DISTRICT has side yard setback requirement of 20 feet
and you provide a side yard setback for addition (1) of ten and seven
tenth feet (10.7') and for addition (2) you provide eleven feet (11').
For addition (3) you provide eleven and a half feet (11.5').
R-20 ZONNING DISTRICT also has a front yard setback requirement of
35 feet and you provide a front yard setback of twenty-two and six
tenth feet (22.6') for the (4) front porch with steps.
It is my understanding that the above ground pool w/deck shown
on your survey map are to be removed. Neither of these structures
has a c.o.
You have the right to appeal this decision to the Zoning Board of Appeals
within 60 days of the date of this letter. The required forms can be obtained
at this office.
