Resolution Authorizing the Establishment of an Escrow for a Proposed Senior Citizen Assisted
Living Facility (Route 91))
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New
York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on March 10, 2009.
The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being called,
the following were present:

The following Resolution was introduced by Councilman Beale and seconded by Councilman
Bettina.
WHEREAS, the Town Board was presented with a request to consider re -zoning a certain parcel
located on Route 9D in the Town of Wappinger for the purpose of a proposed senior citizen residential
project; and
WHEREAS, the Town Board referred such conceptual project to the Sewer and Water
Committee to review the impacts upon the Town; and
WHEREAS, the Sewer and Water Committee determined the need to establish an escrow for the
purpose of reimbursing any professional fees in connection with the review of the proposed water and
sewer impacts; and
WHEREAS, the Town Board discussed the establishment of an escrow at the March 10, 2009
meeting, and determined the amount of Ten Thousand Dollars and 00/100 ($10,000.00) to be adequate to
reimburse any professional fees in connection with the review of the proposed water and sewer impacts.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger
hereby establishes the escrow amount of Ten Thousand Dollars and 00/100 ($10,000.00) for the purpose
of reimbursing any professional fees in connection with the review of the proposed water and sewer
impacts of a proposed senior citizen residential project located on Route 9D in the Town of Wappinger.
The foregoing was put to a vote which resulted as follows:

As you now know, with the Town's support, we would like to explore a potential extension of
municipal water and sewer services south, along the Route 9D corridor, to serve the above
referenced seniors' care medical facility. The anticipated average daily water usage is
approximately 50,000 gallons based upon current Dutchess County Health Department standards
and the current proposal to construct 144 two bedroom units and 96 one bedroom units. We
understand that there will be significant costs associated with an extension of these services, and
that existing capacities of the water supply and sewage treatment systems are also issues that
must be investigated. The applicant understands that these improvements would be extended at
his expense and that the extension could benefit existing portions of the town.
We request to meet with the Town's elected Officials at the March 10 Town Board meeting to
discuss the topics of water and sewer contributions and the design standards that might be
imposed to facilitate a future expansion of these services.
In light of the moratorium that is currently in effect, the applicant requests to investigate the
water and sewer feasibility issues for the project with the town staff and professionals at his own
risk. He also requests to establish an escrow fund to compensate the town professionals to review
the water and sewer issues.
