Please find enclosed within this submission the following:

· One (1) copy ofletter from Zoning Administrator dated 9/11/03
The subject parcel resides within the HB zone. The Applicant is proposing to
construct a 2-story :f:5,100 square-foot building (:f:2,550 SF/floor). The project
is currently seeking approval from the Town Planning Board. As is evident by
the application, there are several variances being requested. This is based on
the fact that the lot is undersized, leaving the parcel with a very limited
building envelope. Additionally, there are federally regulated wetlands on and
adjacent to the site that further reduces the building envelope size.
On December 3,2003, representatives for the Applicant met with Tatiana
Lukianoff and Al Roberts regarding the required variances for the proposed
development of the site. There are several appurtenances required in order for
the site to properly function. These appurtenances include a sewage treatment
system, air conditioning, generator and dumpster.
The sewage treatment system has several components, most of which are
required to have access to final grade. Additionally, an accessory building is
required for sand filtration. It was determined at the aforementioned meeting
that the system as a whole required a variance for the rear yard setback. The

closest individual component (post-aeration tank) was to determine the
requested relief. The post-aeration tank is located such that the distance to the
nearest part of the tank from the remaining wetland is 9 feet, therefore the
Applicant is seeking relief of 21 feet. It is worthy to note that the site is
required to abandon the sewage treatment system and hook into the Town
sewer system when it becomes available. It is anticipated by the Town
Engineer that the central sewer will be available in approximately seven (7)
years. At such time that the site hooks into the sewer system, the individual
components are all required to be abandoned.
The air conditioning, the generator and the dumpster all require concrete pads
that are considered structures. As these structures are located within the
setbacks, variances are required. The air conditioning pads are (at closest) 28
feet from the rear line, requiring a relief of 2 feet. The generator pad is also
located 28 feet from the rear line, requiring a relief of 2 feet. The dumpster
pad is located 4 feet from the side line and 41 feet from the front line requiring
a relief of 6 feet and 34 feet, respectively.
The final variance sought is for the under-sized lot. Based on the zoning code
and on the aforementioned meeting, a variance is required for the lot size.
Pre-existing under-sized lots would not require an area variance if all required
dimensions with the exception of lot width and lot depth are met. As the
street frontage falls 0.67' short, a variance is required.

Moreover, I will definitely request that, should the Zoning Board of Appeals grant this
appeal, conditions be imposed on the variance so that the structure in question,
. particularly the sand filter building, eould not be converted and/or adapted for another
use once the presently specified use is discontinued. .
