Dear Mr. Serino,
Based on the information provided by your letters dated January 15, 2004, January 22,
2004, and February 11, 2004, and referring to Section 240-05 of the Code of the Town of
Wappinger I have prepared the following determiriation. The use which you describe and
propose is determined to be an "adult use" and not.a strictly "retail" use.
The above referenced section of our zoning ordinance states "Any use ..... which includes
any Jorm oj adult use as a principal use or as an accessory use shall be considered an
adult use Jor the purposes oj this chapter. "
As I had discussed with you, "adult uses" are permissible in the Highway Business (HB)
zone. They do, however, require a Special Use Permit and are subject to Special Use
Permit standards and requirements.

Pursuant to our conversation of earlier today, please accept this addendum to my original application
dated January 15, 2004.
Be it known that we will not be restricting access to the store as a whole to those under the age of 18.
Inside the store will be a section containing less than 20~'o of the stock in trade to which minors will not
have access. This section will contain the adult materials previously described in the original application
letter. This practice will allow the store to operate as a non-adult use according to the Town of Wappinger
Code.

Pursuant to your instructions, please accept this letter as notification/application to open a retail store
in the Town of Wappinger. I am opening a retail clothing, gift and party store located at 1182 Route 9 in
the Town of Wappinger. The projected opening date is February 15, 2004.
The store, to be called "Giggles", will oiler the sale of apparel, including but not limited to clothing,
t-shirts, shoes, boots, hosiery, lingerie, swimwear, club wear, evening wear and casuaJ wear; giftware,
including but not limited to games, candles, incense, novelties, jewelry, posters, gift sets and room decor;
and party ware, ineluding but not limited to greeting cards, wrapping paper, gift bags, table ware, party
games. party favors and decorations. I also plan to offer a small selection of adult video, dvd, periodicals
and other products adult in nature. The percentage of adult material will not exceed 20% of the products
offered, i.e., stock-in-trade.
At our last meeting, I asked you for aJI of the paperwork and forms that were required to be
completed in order to open a retail store in the Town of Wappinger that required no renovations. You said
that there wasn't any paperwork and that I should simply write a letter to the Town outlining my intentions.
As it turns out, my files contained the enclosed forms and instructions that were obtained from your office
in early 2003. I have completed the forms and they are included along with a check in the amount of
$35.00, the required fee. As we have previously discussed, the entire building and the parking lot are all
existing and there is no renovation or improvement that would require a building permit. The forms have
been completed for a Change of Occupancy with an Owner Consent Form. I have also included a copy of
the instructions I received.
If there is anything else that is required or any other information that is needed, please do not hesitate
to contact me as I am eager to meet my projected opening date.
