3. Reason for appeal
a. If your variance(s) is (are) granted, how will the character of the neighborhood or
nearby properties change? Will any ofthose changes be negative? Please explain
your answer in detail.
The character of the neighborhood has not changed since the installation of the
pool and deck. Both are hidden by a hill from street view. There is a wooded
area between neighbors on each side of the property and to the back that prevents
the view ofthe structures except during the winter months. None of the changes
have been negative.
b. Please explain why you need the variance(s). Is there any way to reach the same
result without a variance(s)? Please be specific in your answer.
I need a variance because of the way the lot is laid out. The only place
that would allow a pool without a variance and be within allotted zoning
regulations would be on top ofthe septic system/leach field. At the time I bought
the pool I assumed that it would have to be placed no closer than ten feet from the
property line, therefore I placed it in the center of the back yard.
I need a variance for the deck for the same basic reason; I thought it only
needed to be ten feet from the property line.
c. How big is the change from the standards set out in the zoning law? Is the
requested variance(s) substantial? Ifnot, please explain, in detail, why it is not
substantial.
The deck is located 47 feet 5 inches from the property line and the pool is
located 30 feet 7 inches from the property line. I am requesting a variance of2
feet 7 inches for the deck and 19 feet 5 inches for the pool, both of which are not
substantial. There is still plenty of room around both structures.
d. If your variance(s) is (are) granted, will the physical environmental conditions in
the neighborhood or district be impacted? Please explain, in detail, why or why
not.
The physical environmental conditions within the neighborhood have not
been changed at all. The location of both structures was chosen to allow for
privacy and to ensure that the area remained relatively unchanged after
installation.
e. How did your need for an area variance(s) come about? Is your difficulty self-
created? Please explain your answer in detail.
While the need for a variance is self-created, I believe that there is no
other possible place on the property that is suited for the installation of a
swimming pool. The deck requires a variance because I thought it simply made
sense to extend the deck to the swimming pool.
f. Is your property unique in the neighborhood that is needs this type of variance?
Please explain your answer in detail.
While the shape of my property may be unique, it is basically the same as
most properties within the area I live. The area I live was subdivided into lots of
relatively the same size.
