The Zoning Board ot Appeals has vote.d to grant: a variance of 17.5 feet for the
l'om:truction of. a16 X 16. feet open deck. Where the code states that this applicant
nppnR 25 feet to the side yard setback, the applicant can only supply 7.5 feet. The
ZRA noted the very small size of the lots in this development.

Your application # 24625 for a permit to install an 16' x 16' open deck is
hereby DENIED on the basis of Section: 240-37 of the Town of Wappinger
Zoning Law, which stipulates:
R-40 ZONING DISTRICT has a side yard setback requirement of
twenty-five feet (25') and a rear yard setback requirement of fifty
feet (SO') and you provide a side yard setbacks of seven and '/2 feet
feet (7.5'), and a rear yard setback of twenty-three feet (23').
You have the right to appeal this decision to the Zoning Board of Appeals
within sixty (60) days of the date of this letter. The Zoning Board of Appeals
meets the second and fourth Tuesday of the month. The area variance
appeal will require at least two meetings, one for discussion and one for a
Public Hearing. The required forms can be obtained at this office.
