The Zoning Board of Appeals has voted to grant a variance of 22 feet for an existing
12 X 17 feet open rear deck. Where the code states that 50 feet is required to the
rear yard, the applicant could only provide 28 feet.

Dear Mr. King:
Your application # 24751 for a permit to construct an 12' x 17' open rear deck is
hereby DENIED on the basis of Section: 240-37 of the Town of Wappinger Zoning
Law, which stipulates:
R-40 ZONING DISTRICT has a rear yard setback requirement of fifty feet
(50') while you provide a rear yard setback of twenty-eight feet (28').
You have the right to appeal this decision to the Zoning Board of Appeals within 60
days of the date of this letter. The Zoning Board of Appeals meets the second and
fourth Tuesday of the month. The area variance appeal will require at least two "
meetings, one for discussion and one for a Public Hearing. The required forms can
be obtained at this office.
