FOR OFFICE USE ONLY
1. The requested variance(s) (x) WILL / ( ) WILL NOT produce an undesirable change in the
character of the neighborhood.
( ) YES / (x) NO, Substantial detriment will be created to nearby properties.
2. There' ( ~ IS{ARE) / ( ) IS{ARE) NO other feasible methods available for you to pursue to
achieve the benefit you seek other than the requested variance(s).
3. The requested area variance(s) (x) IS{ARE) / ( ) IS{ARE) NOT substantial.
4. The proposed variance(s) (x) WILL / ( ) WILL NOT have an adverse effect or impact on the

6. The property ( ) IS / (X) IS NOT unique to the neighborhood.
Conclusion: Therefore, it was determined the requested variance
Be ( ) GRANTED (x) DENIED.
Conditions/Stipulations: The following conditions and/or stipulations were adopted by resolution
of the Board as part of the action stated above:
The ZBA has voted to deny the two requested variances b a vote of 5 to 0 based on
or. rager s motJ.on w ich is as follows:
I motion to deny these variances. I don't believe the requested variances would -
be detrimental to nearby properties. Would an undesirable change occur to the -
character of the neighborhood, to an extent it will because like we said I did not -
see any other buildings that come in front of homes on that road. Are there other _
alternative methods to achieve this, yes I think there are. There is quite a bit of
~creage there. I agr~ it slopes down but I think they probably could find a place -
lD the bac~ to. put this s~ed. Especi.a1ly since you will not be driving anything in -
and out of It like you S81d. The vanances are substantial. Would the variance
cause adverse affect to the physical and environmental conditions in the
neighborhood? It's questionable and very possible and obviously the difficulty is
self-created.

Today I have inspected the above referenced premises with regards to the proposed

shed would necessitate:
. receiving the variances enumerated in the appeal

I am aware that you and the other members will be conducting a site inspection.
However, ifneeded, I will also have photographs of the site for your perusal.

SUBJECT: 35 FOREST VIEW ROAD
This morning, Tatiana Lukianoff came to my office and informed me that the
owner of the above property has asked for a variance to build an accessory
building on his property, which will require an additional driveway onto Forest
View Road.
As of today, an application has not been made to my office, for an additional
driveway.
At Tatiana's request I inspected the above site and found the site distance for an
additional driveway unacceptable, which will result in denial of any additional
curb cut for this property.

Mr. Victor Fanuele, Chairman

Zoning Board of Appeals
RE: Vince and Jianbro Mulligan
Appeal No. 07-7353
Dear Mr. Chairman,
My wife and I are sorry we could not attend tonight's meeting to discuss the variance for the above noted
appeal. Unfortunately, I have to work and my wife has to be with one of our children at a soccer game. We
would like to express our feelings on the appeal in this letter.
We live directly across from the Mulligans and have no objection to their request to be able to install a 12' x
30' prefab shed in the left side of their front yard. We feel that it will not significantly impact the woodsy
nature of the neighborhood. The Board may want to consider having the Mulligans plant some shrubs in
front of the shed and on the left side to further lessen the impact of the shed to the area.
Please consider issuing variances to allow this accessory structure to be placed in their front yard and for the
side yard setback to be 10' instead of 25' as their yard slopes significantly and the flattest area is from 10' to
25' from their side property line.
Thank you for considering our opinion.

We are concerned neighbors in the town of wappingers. It has come to our attention that
one of our neighbors the Mulligan\'s would like a variance to build a garage in what is
the front yard of the home at 35 Forest View Road. I understand there are property
constraints because of the terrain but feel a garage in the front yard would affect the
integrity of the whole neighborhood. We are not in support of the variance. Thank you.
