Reference: 18 Fenmore Drive
Dear Supervisor Smith & Board Members:
As per your request, we attended a field inspection of the above referenced house
on May 16th, 2000 with respect to location of the existing sewer lateral.
As you are aware, the resident of 18 Fenmore Drive wishes to connect to the
existing sewer system. In doing so, they asked Camo Pollution Control for the
location of the tap and the end of the lateral. Camo Pollution Control consulted
the existing as-built drawing for that street and marked out the wye location in
the street and the end of the tap.
The marking out of the as-built showed that the end of the sewer lateral is
directly under a 12" pine tree. How it got there is conjecture at this point, as the
main was put in 1975. It has been Mike Tremper of Camo Pollution Control
experience with the as-built, that they are fairly accurate and he has no reason to
doubt the exactness of the location.
With that in mind, we used the survey map that the resident had and made a
preliminary determination that the tree is within the Town right-of-way.
There are two (2) options available to the homeownerlTown for the installation of
the sewer lateral:
1. The tree could be removed and the existing sewer lateral could be
extended to the house.
OR
2. A new sewer tap could be constructed in the street at a lower
elevation and extended to the house.
It would seem the cost of removing the tree at this point is substantially less than
the cost of shifting the location of the sewer lateral.

With that in mind, it would be our recommendation that the tree be removed and
the homeowner extend the sewer lateral to their home.
The decision for the Town Board to make is whose responsibility would it be to
either take the tree down or to cover the cost of relocating the sewer lateral. The
Town did not place the tree there, however, the Town did place the lateral there.
Knowing what the Town's thoughts were in 1975 would be purely conjecture
now, but it would seem that the Town would not have placed a lateral directly in
the line of a large tree if it was there at that point in time.
