Dear Supervisor Smith & Board Members:
As you are aware, we are in the midst of the construction for the above referenced
project. The project entails the installation of a sanitary sewer collection system
for the area known as Wappinger Park just south of Hopewell Road, just west of
Route 9. The Contractor for the project is Merritt Construction, Inc.
The current specifications calls for the contractor to replace the pavement that was
removed for the installation of the sanitary sewer with two (2) 2 %" lifts of binder
course of blacktop. We had planned at that time for the Highway Department to
top the entire roadway with approximately 1 %" - 2" of blacktop. As the
subdivision currently has a central water system and a closed storm drain system,
this construction should preclude the necessity of any major excavation in the area.
During the early stages of the excavations within the Wappinger Park Subdivision,
the Highway Superintendent, Graham Foster, observed that the roadway, the
residents, and his department might be better served by deleting the installation of
the above trench replacement pavement and allowing his Department to grind
down the entire roadway and remove approximately 5"-7" of material, and then
binder the entire width of the roadway. This will allow the existing unsuitable
pavement to be removed and replaced with the new road.
Of prime importance here is the fact that the removal of 5"-7" of material will allow
the road to be replaced to a lower elevation and not cause any drainage problems,
(As you are aware, in other sections of the Town, the constant repaving of the
road(s) raises the road to such an elevation so as to sometimes cause drainage
problems for existing structures).

The sections of road completed this year could then be entirely bindered, and next
construction season, after the entire project is completed, the Highway
Superintendent will put down a top course across the entire roadway. This will, in
essence, make an entire newly constructed road.
After review with the Highway Superintendent and the contractor, this office
endorses Mr. Foster's proposal without reservation.
The Town is under contract with Merritt Construction, Inc. to repave the trench
with two (2) layers of binder type blacktop, including the installation of
approximately 12" of subbase material (which is and will be continued to be
installed).
The unit price bid for this trench replacement pavement will need to be
renegotiated with the contractor, Merritt Construction, Inc. The current unit price
for this installation is $32.00/S.Y.
The contractor has submitted a revised unit price of $ 11.62/S.Y.
This reduction reflects the removal of the blacktop portion of the bid item,
installation of approximately 17" of Item 4 subbase material instead of 12", and
the appropriate profit margin the contractor had in it's unit price for the overall
project.
The net result to the original contract called for 3,605 S.y. of asphalt restoration at
$32.00/S.Y., aggregating $115,360.00.
If the new unit price is accepted, the amount of the item will be 3,605 S.y. at
$11.62/SY aggregating approximately $ 41,890.10.
This office in conjunction with Graham Foster, Highway Superintendent, and
Charles Me'rritt, President of Merritt Construction, Inc. endorses this change order
and would like the Town Board to authorize the same.
