Dear Mr. Roberts:
In reviewing the October lOth, 2000 letter from Niki Pagones, Esq. regarding the above
referenced property, we offer the following responses to Item No.5:
a. The easement will be staked ten (10) days prior to clearing. Once the easement is
staked, who should be notified?
b. The cleared trees will be neatly staked outside the easement area.
The stockpiling of the surplus soil outside of the easement presents a problem.
According to the conditions contained in the New York State Environmental
Conservation Wetland Permit, all excess spoil shall be removed from the wetland
and buffer zone areas to insure that the finish grades are the same as the pre-
construction topography. With the proposed easement and adjacent area being
located within the wetland buffer zone, the stockpiling is prohibited.
