Dear Supervisor Smith:
As per your request, please be advised that the parcel of land located on
Myers Corners Road just west of Roberts Road and as discussed with
Doug Nessler, is located within the Phase 1 of the Wappinger Sewer
Transmission/Treatment Improvement, and therefore, has current
available capacity for sewer.
A review of the records would indicate that the parcel is not located
within the confines of any water district, and therefore, could not use the
services of Central Wappinger Water Improvement or Oakwood Knolls
Water District without the benefit of a Water Supply Application.
I have also reviewed the minutes of the August 19, 1996 Town of
Wappinger Planning Board meeting, in which a conceptual discussion was
held with the potential applicant, Mr. Bob Novak. The above information
was given to Mr. Novak and his Engineer at that meeting with other
recommendations. I have enclosed a copy of these minutes for your
review.
I would recommend that you transmit a copy of this letter and the
minutes to Mr. Nessler so that his concerns can be addressed.

Mr. Parsons explained they have to have a public hearing for final
approval. Every subdivision requires 2 public hearings. The Board can
waive the final public hearing when it is a minor subdivision that
received preliminary approval and final approval follows right behind it.
He said this subdivision received preliminary 6 years ago, so they have to
bold another hearing.
CONCEPTO~
Mr. Bob Novak (Contract Vendee) - To discuss a 9 lot subdivision located
on Myers Corners Road.
Mr. Novak (contract vendee) and Mr. Day (Barger, Day & Oswald) were
present.
Mr. Day explained that Mr. Novak would like to purchase the property. He
said they want to get the feeling of the Board. He said he had conceptual
discussion with the Board of Health and Mr. Paggi concerning the
connection to the Oakwood Knolls Water. He said they would rather have
them tie into the system that is on Spook Hill Road. He said this piece
of property is adjacent to the Wappinger Golf Park. He asked if they
would want the cul-de-sac to touch the property line. He didn't see any
benefit in doing that.
Mr. Parsons explained a while back they discussed that, but at that time
there wasn't any good place to tie into. He felt if they are going to do
a cul-de-sac, it should go to the property line.
Mr. DiNonno asked why. He said it would serve no purpose.
Mr. Parsons said nobody knows what is going to happen to the piece next to
it.
Mr. Novak said he thought the gold park was in the process of getting
approval.
Mr. Parsons said nc. He caid if it was ever develcped as resider.tial,
then it would certainly pay to tie into there.
Mr. Paggi said that doesn't abut the Wappinger Golf Park. It abuts
Stach's property.
Mr. Parsons asked what is the problem with having the cul-de-sac go
another 5 feet and touch the property line.
Mr. Day.said if he was Stake, he wouldn't want the cul-de-sac there.
Mr. DiNonno said it would be more pavement. He didn't feel it would serve
any purpose.
~. Wery asked where they would put the road if they didn't have to go to
the property line.
Mr. Day said they would shorten the cul-de-sac up and they would have a

green space on the end of the cul-de-sac so stake wouldn't be impacted it.
Mr. Roberts asked how many lots they are proposing.
Mr. Day said 9 lots.
Mr. Parsons said it is irr a R-20 zone. He said they used to be in the
chicken business and then they had a deli, and then they moved to Florida.
Mr. paggi said they will need water, sewer and a highway permit from DPW.
Sewer, they can count on. They have a sewer line right out front. It is
Dot in the water district so they have to do a water supply application.
He said they would like to see the main connected to Spook Hill Road. He
said back in 1972 they ran it down Spook Hill. It crosses Myers Corners
and down the north side of Myers Corners past Hannigans. He said they put
a T with a valve to head west. He said that has been realigned so he
doesn't know where the T is now.
Mr. Parsons asked Mr. Paggi if right now there isn1t sufficient water for
9 houses.
Mr. Paggi said no, not outside the district.
Mr. Day asked if it is in any water district.
Mr. Novak said the owner of the property lead him to believe it is in the
Oakwood district.
Mr. Day said he understood it to be in the Oakwood district, but there is
no supply. He said on the tax map there is a line that runs right up the
middle of the road.
Mr. Paggi said they are in the process right now of looking at augmenting
central Wappinger, which is what they would tie into. He said it is
before the Town Board. He said it won't be done between now and october
15th. The other problem is drainage. He said they have drainage problems
with the existing Oakwood Knolls subdivision -and Wappinger Gold Park. He
said any runoff that goes to the north or the west will be looked at. He
said they would be looking for total mitigation.
Mr. Parsons said they have sewer. water will be coming. He said that
~ll come on from Atlas. He said the problem would be drainage.
Mr. Novak asked where they would tap the water.
Mr. Paggi said it would have to come down from spook Hill.
Mr. Novak asked if it is feasible as far as construction and financial.
Mr. paggi told them it is up to them to figure that out. He said the
water main is on the north side of Myers Corners Road.
Mr. Day asked Mr. Paggi if he hit rock there when they put the main in the
front.

Mr. Paggi told him to check the logs. He said the sewer is on the south
side of Myers Corners and the water comes down the east side of Spook Hill
and then they open cut it to Myers Corners Road to the north side with a T
and a valve heading west and then they went east because the water
district ends right there.
~. Novak asked if they could go down through Pattie Place for the sewer
and tie in like it is shown on the map.
Mr. Day said the plan shows they would hook both water and sewer up in
Pattie Place.
~. Paggi said he will have to look at that. He said they prefer the
sewer go out the front. He said the sewer is on the south side of Myers
Corners Road, east of Spook Hill. He said it is right in front of their
place_
~. Novak asked if it is deep enough.
Mr. Paggi said he didn't know the elevation, but he could give Mark the
profile.
Mr. Day said they would probably have to pump to it.
Mr. Parsons asked if the Board had any problem with the project.
The Board didn't have a problem with it.
Mr. Novak asked what the next step is.
~. Parsons told him the next step is to come back and see if they can get
the drainage in the way they want it.
~. Paggi suggested that Mr. Day should do a little more feasibility work.
Mr. Day said right now they are trying to put a feasibility together. He
said the reason they came before the Board was.to see if they could
shorten the road ~p 100 feet.
Mr. Paggi told Mr. Day to locate the T.
Mr. Garel! - To discuss creating a flag lot located on Wheeler Hill Road.
Mr. Garell (owner) and Mr. Shetter (contract vendee) were present.
Mr. Gar~ll explained he owns the lot that Mr. Shetter wants to purchase,
but present access is through a maze of right-of-ways.
~. Parsons explained you can't build a house on a private road anymore.
He said it has to have access over its own property to a public highway.
He said the one lot would be taken care of if they give it SO feet on the
Town road. He said that would make it a flag lot. He asked where do they
stand with the rest of the lots that are vacant. He asked him if he
wanted to add another SO feet to make a second flag lot.
