Reference: Proposed Cellular Tower Legislation

I am in receipt of your transmittal dated March 6, 1998, more specifically a
draft of Proposed Local Law regarding the regulation and placement of
telecommunications towers in the Town of Wappinger. I have reviewed
the same and offer the following:
Please note that as I am not an expert in the field of telecommunications,
and therefore, I have tried to review the proposed Local Law as it relates to
general municipal engineering.
1. It appears as if there will be areas where telecommunications
facilities are going to be allowed. It is my guess that this list will be
itemized in the final Local Law, and will be a result of input from
both the telecommunications expert and the Town Planner.
2. There is a section on Page 6 that states repeaters may be installed
within the locations approved for the normal facilities or in the rest
of the Town of Wappinger. The obvious question is, "00 we want
to limit the locations as to where these repeaters may be installed?"
3. On Page 7, it goes on to state that a Repeater Special Permit could
be installed on a newly permitted Tower. This is confusing language
in light of my Comment No.2. It assumes and/or applies that a
tower may be installed anywhere in the Town.
4. On Page 13, it states that a Urecent" survey of the Tower Site will
be required. I would substitute ucurrent certified" for the work
Urecent" .

5. Also on Page 13, it states that there must be a minimum of 5'
contour intervals. I believe it should be 2' contour intervals.
6. On Page 14, it states that a Licensed Land Surveyor must complete
the survey plan within two (2) years prior to the application date. I
would change that sentence to state, UThe survey plan must be
completed by a Licensed Land Surveyor and certified as being
accurate." Certification must have the current date included.
