Reference: Evergreen Estates - Section II
Dear Board Members:
I am in receipt of a transmittal letter dated September 1 at, 1998 from Michael
Gillespie from Day, Oswald & Gillespie regarding the above referenced project. In
this transmittal letter, Mr. Gillespie states that he has transmitted to our office a
copy of the subdivision map last dated August 15th, 1998, and copies of deed
descri ptions.
I have reviewed the same, and report the following:
1. The Road Descriotion dated AUQust 1 srh, 1998: I have reviewed the
description and find that it corresponds to the metes and bounds as shown
on the subdivision map. I would question, however, that the description
goes straight through the cul-de-sac and not around it. The cul-de-sac is
described as temporary in nature. I would recommend that the description
deeded to the Town go around the cul-de-sac, and a note be placed on the
subdivision map that, if and when, the road is extended that the land will
be abandoned to the adjacent property owners. By copy of this letter, I
am asking AI Roberts what his opinion is.
2. Snow Easement No. 1 dated AUQust 1 srh, 1998: I have reviewed this
easement and find that it is consistent with the metes and bounds as
shown on the proposed subdivision map. There are, however, two
references to temporary turn-around. I believe the word "temporary"
should be stricken.
3. DrainaQe Easement No.2 dated AUQust 1srh, 1998: I have checked the
metes and bounds description and find it consistent with the proposed
subdivision map. However, there are two references to temporary turn-
around. I believe this should be stricken.
4. GradinQ Easement No. 3 dated AUQust 1 srh, 1998: I have reviewed this
description and find it consistent with the proposed subdivision map,
except the word "temporary" should be stricken.

5. Snow Easement No.4 dated Auaust 1EY", 1998: I have reviewed the
same and find that there are two references to "temporary" that need to
be stricken. However, the description corresponds to the proposed
subdivision map.
6. Drainaae Easement No.5 dated Auaust 1~, 1998: I have reviewed the
same and find that there is a discrepancy between the map and the
description in the length of the curve noted as 27.53'. Review of the map
shows that it is drafted at 27.63'. Other than that it is consistent with the
proposed subdivision map.
7. Drainaae Easement No. 6 dated Auaust 15'h, 1998: I have reviewed the
same and find it consistent with the proposed subdivision map.
8. Drainaae Easement No. 7 drafted Auaust 15'h, 1998: I have reviewed the
same and find it consistent with the proposed subdivision map.
By copy of this letter, I am notifying the surveyor of our findings, and asking him
to make the necessary revisions.
I am also asking AI Roberts to render an opinion on whether or not the description
should go around or through the cul-de-sac.
