Dear Mr. Checchia:
I am in receipt of your July 1 st, 1998 memorandum regarding the above
referenced project. I offer the following in connection with the comments
contained in that letter:
1. Our review of the post-lining video shows a potential obstruction on
one" of the easterly sewer laterals. However, your offer to perform
intermittent inspections during the warranty period to confirm
successful operation of this lateral is acceptable to this office.
Please inform us in writing when your initial inspection will be made.
2. Your preface to the statement that JI. . . the liner is fully opened
and processed", does not belong in this sentence. However, we do
agree that the liner in place is fully opened and processed.
3. We have raised some concerns regarding the last 23' of the lining.
There is a certain section immediately upstream of the manhole that
has deformed. You state in your letter that it is the last foot. I do
not know that to be true. However, I do agree that it is the last
section of the 23'. You recommend a solution to ream out the
deformation and install a cured-in-place point repair. This is an
acceptable solution to the problem. You stated to me that you can
do a maximum of a 10' section utilizing this type of repair. I do not
believe the deformed section is that long, and therefore, find this
proposal acceptable. Would you kindly confirm in writing the date
that you wish to perform this repair, and acknowledge the fact that
the cost of the repair is under the terms of the original contract.

4. We take exception to the your statement(s) and logic used in
Comment No.4.
. I do not know for a fact that the point repair by Ben Ciccone, Inc.
was obviously "due to a collapse in the host pipe, which
prevented the liner from curing".
. You then quote section 4.01.3(D) of the contract specifications.
This section of the Contract Specifications refers to a procedure
where immediately after the pre-video the Contractor informs the
owner representative that there is a obstruction or collapsed pipe
that will prevent installation of the liner, and an excavation needs
to be made to repair the obstruction. At this point, this
excavation needs to be approved in writing prior to
commencement of the work and it shall be considered a pay
item. Your concluding statement to have Ben Ciccone, Inc.
submit their bill with all necessary backups to your office so that
you may submit them for payment to the Town is, therefore, not
in accordance with the Contract Specifications.
. In a telephone conversation with you on this date, you indicated
that in the pre-liner video the failure and/or collapse pipe was not
evident to anybody, and that the point repair would have had to
be made in any event. I:
1) feel it is the Contractor's responsibility to inform the owner
that the point repair needed to be made prior to lining.
2) feel that the point repair would not have had to been made
during premium time (overtime).
3) feel that the point repair would not have had to been made to
the length (54:t') that it was made.
4) Feel that the cost incurred by Ben Ciccone, Inc. to repair and
restore the two sewer laterals was not part of the point repair.

I would recommend that you review the contents of this letter and contact
me Monday, July 6th, 1998 to arrange a mutually convenient time to
discuss this matter so we may bring it to a conclusion.
Our office is closed Friday, July 3'd, 1998, however, will be open Monday,
July 6th, 1998.
I am transmitting this letter to you by fax so you may have ample time to
review it.
