Dear Supervisor Smith & Board Members:
Reference:
As instructed, I contacted Joseph Marcogliese of the New York State
Department of Environmental Conservation (N.Y.S.D.E.C.) regarding the
Montclair Condominiums and their potential for inclusion in the above
sewer improvement.
As you recall, we had attended a meeting approximately a year ago:at
Mr. Marcogliese's office relative to the work they needed to do at their
treatment facility to make sure that it remains in compliance.
Apparently, they have done the sampling that had been requested by
N.Y.S.D.E.C., and as a matter of fact, N.Y.S.D.E.C. has conducted its
own sampling. After the sampling was analyzed, it was determined that
the plant was in compliance with the permit,. and as a matter of fact,
running fairly well.
To this date, the plant is still in compliance with this permit, and
therefore, Mr. Marcogliese finds no basis for urging or requiring them to
join the centralized sewer system.
With that in mind, I would think that the decision for inclusion rests solely
on the Town Board's opinion of the matter.
In a related matter, Mr. Marcogliese asked if we were pursuing and
following up with the funding of Phase 3A from the Environmental Bond
Act. I mentioned that we were, and are aware that the applications
forms were going to be made available in the April time frame.
