I have reviewed our file and found the following documentation regarding
the above refe.renced subject as it relates to proposed interim plot plans.

December 6, 1995 correspondence from our office to the
Town Board.
o
January 31, 1996 memorandum from Frederick P. Clark
Associates to Don Keller, yourself and myself regarding
the amendments.
February 1, 1996 review letter from our office to
Frederick P. Clark Associates.
I have also reviewed the Town Board minutes and find that at the
January 22, 1996 meeting, our initial request for a change in the building
permit process was discussed. It was moved to authorize Dan Wery to
proceed with the amendments to the Building Permit Regulations.
Apparently, Dan started the process, I reviewed it, and it died there.

I have reviewed the remainder of the 1996 file I have in my possession,
and find no evidence that the subject was brought to a conclusion.
I hope this information is helpful.

I am in receipt of your proposed amendments to Building Permit
Regulations dated January 31, 1996. I.have reviewed the same and
find them acceptable.

Amendments to Building Permit Regulations
However, I would recommend that the word "foundation", as it applies
to elevation, be defined. From my perspective, the foundation elevation
required is the elevation of the top course of the block, and the
elevation of the garage sill block.
As Don said, the enforcement of limitations on the number of bedrooms
imposed by the Dutchess County Health Department Regulations is a
problem, and should be addressed. Possibly, some suggestions from
your office would be helpful.

. Amendments to Building Permit Regulations
Attached for your review and comment are draft revisions to the Town of Wappinger
Ordinance for Administering and Enforcing the State Building Construction Code, otherwise
known as the Town Building Code.
These amendments will require a foundation survey prior to any further construction to
demonstrate conformance with the approved location and elevation on the preliminary plot
plan for all new construction.
Don Keller suggested that the Code might also be amended to require setting an elevation
benchmark on each property to assist in the construction, inspection and enforcement of
building permit requirements. Don also mentioned that enforcement of limitations on the
number of bedrooms imposed by the Dutchess County Health Department is problematic
and perhaps could also be addressed at this time.
Once these amendments have been finalized, they should be recommended to the Town
Board for formal adoption.

PROPOSED AMENDMENTS
TO THE
TOWN OF WAPPINGER BUILDING CODE

indicate wording to be deleted.
SECTION 1. Section 10, subparagraph (c) of the Town Building Code would be amended
to read as follows:
No construction of any portion of a building other than the construction of a
foundation shan commence until the owner has first submitted to the Building
Inspector an "as built" certified plot plan showing the "as built" foundation location

Such plan shall show that such foundation is situated and locat~~\\'ithin tile

the Supervisors office.
If the solution was acceptable, Mr.
Denardo was to have his attorney contact him so details on the
necessary documentation could be discussed and submitted to the
Town Board. The letter was returned unopened.
SUPERVISOR SMITH said that she did receive an affidavit from the
Assessor that the house is being occupied because breakfast
dishes were left out. The School was also contacted, and the
children are being picked up and left off at the house.
The third report relates to the Widmer Road Project including
issues that were discussed with John D'Albro and Al Berberich
and concerns they were having on the proposed project.
They are willing to allow for the necessary easements.
Mr. Paggi would also recommend discussing Wheeler Hill, Spook
and Old Troy Roads at the February Workshop.
COUNCILWOMAN VISCONTI moved to authorize Attorney to the Town
prepare for the necessary land acquisitions for the Widmer Road
Project.
Seconded by Mr. Bettina
Motion Unanimously Carried
Next is a request from Mr. Paggi to add a requirement to the
Building Permit process that would insure to the Town that the
house is being constructed to the proper elevations and yard
setbacks. This additional requirement would have the builder
submit a certified intermediate plot plan at the completion of
the foundation, prior to any framing being allowed, showing the
following:
SIDE YARD SETBACK
FRONT YARD SETBACK
REAR YARD SETBACK
ELEVATION OF THE TOP COURSE OF BLOCK FOR MAIN HOUSE.
ELEVATION OF THE TOP OF BLOCK AT THE GARAGE DOOR.
This plan should be reviewed by the Building Inspector and our

whether or not the house is being constructed to the elevations
and locations as shown on the original approved preliminary plot
plan.

with amendments to the Building Permit Regulations.

The last report is in reference to the Wappinger Sewer
Improvement Area No.1 Additional Collection Lines. Mr. Paggi
recommends a workshop on this as soon as possible so that some
agreement can be reached.
COUNCILMAN RUGGIERO moved to table this to the February
workshop.

The next item for the Boards Consideration is a Change Order for
the Wappinger Sewer Transmission/Treatment Improvement Area
Phase II, Contract 2E.
Change Order No.1. consists of
additional payment for labor and materlals for the generator to
pump station connection.
The additional labor and materials
resulted from field changes required on the generator set, The
switch which controls the electrical supply to the pump station
was mounted on the opposite side of the generator due to
structural restraints of the fiberglass enclosures. Also, this
change allowed the communications and alarm wiring to be
installed in a more accessible location. The additional cost of
labor and materials was due to the extra 4 inch galvanized steel
conduit and electrical wire required to connect the above

Dear Supervisor Smith and Board Members:
It has come to my attention in the past month that it would be a good
idea to add a requirement to the building permit process that would insure
to the Town that the house is being constructed to the proper elevations
and yard setbacks.
This additional requirement would be to have the builder submit a
certified intermediate plot plan at the completion of the foundation, prior
to any framing being allowed, showing the fOllowin-g:
o Side Yard Setback
o Front Yard Setback
o Rear Yard Setback
o Elevation of the top course of block for the main house.
o Elevation of the top of block at the garage door.
This plan should be reviewed by the Building Inspector and our office if
necessary. This will assist the Town in determining whether or not the
house is being constructed to the elevations and locations as shown on
the original approved preliminary plot plan.
Would you kindly take whatever steps necessary to insert this in the
Building Permit Regulations.
