Dear Supervisor Smith:
I am in receipt of correspondence from Robert Gray, P.E., dated
December 23, 1994 regarding two (2) lots located in the Town of
Fishkill that he is proposing to become tenants of the Watch hill Water
District.
I have reviewed the correspondence, and would recommend the
following:
1. The documentation submitted by Mr. Gray showing
that the lot owned by Mr. Klassen had approval to
become a tenant in 1984. Under current Town
regulations this would not be valid. As you recall, a
few years ago the Town adopted standards that made
approvals such as this good for one (1) year only and
then the Applicant must re-apply.
2. The Town would be required to own and operate the
water service from the main to the curb valve.
Therefore, the construction detail, including sizing
would be rather important and would need to be
spelled out in further detail.
3. The Town will need to have rights to enter upon the
right-of-way of lands of the Town of Fishkill to operate
and maintain these service connections.

4. Pressure testing will need to be done on the existing
water line at point of connection to insure that
adequate pressure can be supplied to the two
residences.
5. All administrative items, such as Water Supply
Applications (if necessary), will need to be filed by the
Applicant at no cost to the Town of Wappinger.
6. Proper documentation from the existing house should
be provided to the Town of Wappinger that they
acknowledge that they will become tenant of the
Watchhill Water District, and that they are aware of
the current rate structure for tenants and the current
rate structure for the district.
I would recommend that this correspondence be transmitted to Mr.
Gray, and advise him that these items and possibly other items will need
to be addressed prior to allowing this tenancy. It is not a cut and dry
matter as it may appear.
If there are any other questions or comments, please do not hesitate to
contact this office.

Pursuant to your instructions, we have reviewed the letter request dated December 22, 1994
from Robert Gray, P.E. on behalf of Otto Klassen requesting that the Town of Fishkill grant
authorization to the Town of Wappinger to allow the above parcels to connect to the Wappinger
Watch Hill Water Improvement Area.
Based on our review of the matter, the following comments are offered for your consideration:
1. There are two parcels involved in this request. One parcel is located on the north side
of Birchwood Drive, is owned by Klassen, is vacant and is seeking Dept. of Health
approval. The other parcel is located on the southerly side of Birchwood Drive
immediately across from the Klassen parcel. This parcel is apparently owned by John
Swarner Jr. The parcel is fully developed. In order to develop the parcel owned by
Klassen, the Swarner well must be abandoned and the parcel connected to a municipal
water source. Klassen is apparently going to pick up any and all costs associated with
this proposal.
2. The subject properties are located in the Town of Fishkill but are not in the Brinkerhoff
Water District. The nearest available water line is in the Town of Wappinger and is part
of the Wappinger Watch Hill Water Improvement Area. The parcels do not appear to be
in the permitted service area for either Brinkerhoff or Watch Hill. Service to these
parcels would appear to therefore require that a Water Supply Permit be obtained from
the NYSDEC permitting the extension of service.
3. The parcel to be developed by Klassen received prior permission to connect from the
Town of Wappinger. The prior permission letter from the Town is over 10 years old,
dated June 5, 1984. This letter is best described as "stale".
