Dear Supervisor Smith:
Enclosed please find a map and a description of a piece of property that
is proposed to be transferred from the Town of Wappinger to Mahmoud
Kablaoui located on Amherst Lane.
As you recall, this came about after a request was made by the property
owner to determine if some trees adjacent to the property line were on
the Town's property or on his property. These trees were adjacent to
the house and were in danger of falling on the house.
When we completed our survey, it was discovered that the property line
as per the filed map and the property line as in possession were radically
different. This difference was caused due to numerous errors in the
filed map that was completed in the early 1960's.
A meeting was held with Dr. Kablaoui, and he agreed to the proposal by
the Town. As you can see from the map, this transaction would move
the property line from the house and deck.
I asked Dan O'Connor of the Dutchess County Health Department if he
had any objections to this, and Mr. O'Connor responded in writing that
he did not if the present and future owners of this property be restricted
from installing a subsurface sewage treatment system on this triangular
piece of property. Possibly, AI Roberts could place that restriction in the
deed that is going to be transferred.
