Dear Supervisor Smith:
As a result of the office meeting of December 21, 1995 with Mr. John
D'Albro and Mr. Val D'Albro, the following items were discussed and
were agreed to be part of the potential right-of-way agreement between
the D'Albros and the Town of Wappinger.
The purpose of the right-of-way agreement would be to allow the Town
to acquire the necessary property to perform the Widmer Road
reconstruction as previously detailed.
The items brought up by the D' Albros, and agreed to by the Town are
as follows:
1. The runoff from the improved roadway will be
channeled to the existing catch basins on both the
north and south side of Widmer Road.
2. The erosion or the finished slope will be kept to a
minimum. It will be lessened by maintaining a 1:3
side slope and immediat~ly stabilizing the freshly
excavated earth with seeding.
3. The roses that exist along the front of the property
will be transplanted along the new right-of-way. This
will be done prior to any construction by a reputable
nursery men and will be included as part of the
construction work.

4. The topsoil that will be used for the restoration work
on the 0' Albro property will be clean and hand raked
so that it will be mowable by the 0' Albro's in the
future.
5. Although the presence of rock is unavoidable, we will
try to avoid blasting. If not, all blasting operations will
follow standard procedures, includin~ using
seismographs and having the blastef'sinsurance
company take a pre-blast inventory of the D'Albro's
property (house).
6. The grade of the shoulder in the fill section for the
0' Albro house will have a grade no greater than 1 :3.
The possibility of slope easement to maintain this
grade might be necessary.
7. New apron for the existing D'Albro driveway will be
built approximately 20' off the edge of the new
pavement.
8. The two front properties pins will be staked by the
Engineer to the Town by using metal rebars.
9. The Town will provide an appraisal of the land to be
given to the Town for the 0' Albro's use.
