Dear Tim:
A field inspection of the above lot was made by me on March
23, 1988 with respect to the proposed grading. The berm
along the northerly property line was installed the entire
length as instructed and the swale to cohvey the runoff from
the property of Lot 65 and others was constructed as shown
on the approved plot plan. However, it should be noted that
contrary to the approved plot plan, the existing contours do
not extend to All Angels Hill Road. This was as viewed by
yourself and myself. The impact of this is to create a
depression in the rear of the newly created fill section
towards the westerly portion of Lot 66. The runoff that
entered that section of property from now or formerly
Kleinhenz and above will stay on the low section of Lot 66
unless other provisions are made. The final plot plan
should show what will become of this water.
I believe that Mr. Segat has taken the majority of the water
that comes down the hill and channeled it into the new swale
which eventually ties into the closed storm drain system on
Sherwood Heights Road. However, the problem that exists
with the rear of Lot 66 still needs to be addressed. By
copy of this letter, I am notifying Mr. Segal of our
position. He should make whatever arrangements necessary
with his surveyor and/or engineer to arrive at an agreeable

solution. Please note that if they can show that this water
will never enter upon lands of Parsons and/or Bennett and
will stay entirely on Lot 66, I would have no objections to
that condition. Please contact this office if there are any
questions or comments regarding the above. Also, as
discussed with you that day in the field, I have no
objections to lifting the stop work order.
