Reference: Survey Wage Rates
Dear Board Members:
I have been informed by the New York State Department of
Labor that effective July 1, 1989, we must pay prevailing
wage rates for consulting engineering survey work that we do
for the Town of Wappinger or for any other municipality in
the State of New Ycrk.
I have enclosed various correspondence from the State
relative to tllis. Included in this definition of survey
work would be feasibility on preliminary work that will be
done ror public work projects. Although the amount of work
we do for the Town presently in this category is not
significant, I feel that I must inform you of this.
Naturallv, the billable rates that we have for these
categories must go up to reflect the actual wage we must pay
our employee.
I have prepared a table for your review that will show the
new hourly wage and the new billable rate. As you can see,
the new billable rate will almost double from the existing
billabl~~ rate.

It has been determined that effective with the next
annual determination of prevailing wage rates, effective
July 1, 1989, any contract for Consulting Engineer Survey
Work awarded after July 1, 1989 which meet~ the definition
below and which is in connection with an existing or
contemplated public project, is itself a contract for public
work for which a schedule of prevailing wage and supplement
rates must be included in the contract specifications.
Included in the definition of Consulting Engineer
Survey Work are feasibility and preliminary design surveying,
line and grade surveying for inspection and supervision of
construction when performed under a consulting engineer
agreement.

ANNUAL PROMULGATION OF PREVAILING WAGE RATES
The annual promulgation of prevailing wage rates will take place
on May 31, 1989. These rates will apply to all new public work
construction projects awarded on or after July I, 1989. The rates
contained in this promulgation will become effective on July I, 1989
and remain ,in effect until June 30, 1990.
A supplemental promulgation will occur on June 30, 1989 and
will contain additional rates taken from collective bargaining
agreements that have expired on or before May 31, 1989, as long as
the negotiations were in progress prior to May' 31, 1989 and an
agreement is reached on or before June 30, 1989.
The rates contained in the supplemental promulgation will become
effective on August I, 1989 and will supersede the rates contained in
the original promulgation. The rates contained in the supplemental
promulgation will apply to all projects awarded on or after August 1, 1989
and any existing projects, regardless of the date on which they were
awarded, that are not completed prior to August 1, 1989.
Collectively bargained rates negotiated after the June 30, 1989
date will not appear in prevailing wage rate schedules until the
following year's promulgation.
The annual promulgation of prevailing wage rates that apply to
new public work projects awarded on or after July 1, 1990 and existing
projects that are not completed prior to July 1, 1990 will take place
on May 31, 1990 and become effective on July 1, 1990.
Collectively bargained rates contained in agreements signed after
May 31, 1990 will not appear in prevailing rate schedules until
July I, 1991.
Note:
When multi-year rates are indicated in a prevailing wage rate
schedule for any particular trade or classification they
become effective as of the date indicated on the schedule.

NEW PREVAILING WAGE RATES TO BE PUBLISHED

Albany, NY (Apr1l18, 1989) -- State Labor Commissioner Thomas F. Hartnett today
announced that the annual determination of the preva1lJng rates of wages and supplements for
workers employed on public work projects throughout the state will be published on May 31.
The new rates will be in effect from July 1. 1989 to June 30. 1990 -- except as noted below.
A supplement to these prevailing wage rates will be determined on June 30 from
. collective bargaining agreements reached between May 31 and June 30. The agreements must
have been in negotiation prior to May 31. The additional rates will take effect August 1. 1989
and supersede the original rates except on projects completed before August 1.
By law. prevailing rates of wages and supplements must be detennined once annually by
the State Department of Labor and published 30 days prior to July 1 of each year. The rates for
various occupations for a given locality are set by the collective bargaining agreements for that
area between bona fide labor organizations and private sector employers.
Collective bargaining rates negotiated after June 30. 1989 will not appear in prevailing
wage rate schedules until May 31. 1990.
Contractors found to have paid less than the prevailing wage may be be guilty of a
misdemeanor and are ordered to pay back wages. plus interest. to all employees affected. The
employer may also be subject to a fine of $500. a civil penalty of up to 25 percent of the amount
owed. 30 days injail. or all three.
The law also provides that contractors who willfully violate the law on two occasions
1i1 six years be barred from bidding on any future public work contracts for a period of five
years.
The present schedule of prevailing rates of wages and supplements is available for.
public inspection at the central office of the Bureau of Public Work. The new schedules will be
available on May 31.
Any publIc agency or political subdivision about to initiate bidding on a publIc work
project should contact the NYS Department of Labor. Bureau of Public Work. W. Averell

of the relevant wage schedule.
