Roberts, Esquire Gellert & Cutler, P.C. 75 Washington Street Poughkeepsie, New York 12601 Reference: Building Permits New Subdivisions Dear Mr. Roberts: In light of the recent problems we had with Lookout Point and Red Hawk Hollow, I find myself being somewhat concerned with the issuance of Building Permits on bonded subdivision roads not yet constructed. It seems to me that we are buying ourselves trouble with Building Permits in such subdivisions as Noto and Red Hawk Hollow, in which, are being issued on bonded roads where the work has not been completed. Although the work is in some stage of completeness, there is remaining work to be done prior to issuance of a Certificate of Occupancy. Primarily, I am referring to the Noto Subdivision, as most of the work on Red Hawk Hollow has been accomplished at this point in time. We are approving the plot plans subject to the completion of this work, and I am recommending that certified letters be sent to Builders and Owners of these parcelS stating the Town's position that the Certificate of Occupancy will not be issued until the road is completed up to the subject parcel. However, I am somewhat concerned and wonder if the Town has any recourse. Please review the matter and get back to me at your earliest convenience. Very truly yours, cYoc-LpCC /2;f;J# Joseph E.
