Information to Bidders:
Sealed proposals shall be received by the Town of Wappinger at Town Hall, 20
Middlebush Rd., Wappingers Falls, New York, until 1:00 P.M. EST February 21. 2002
for 20,000 gallons of gasoline to be us~d by the Town of Wappinger.
Bids shall be submitted on this form and shall be enclosed in a sealed envelope marked
"BID FOR GASOLINE".
Bidders shall have a scheduled 24-hour delivery service, ~even days a week.
Automatic check and fill service on delivery of gasoline shall be maintained.
All deliveries shall be metered and shown on a metered printed gasoline delivery ticket.
The Town Board reserves the right to reject any or all bids, to waive any informalities in
bidding and/or to accept other than the lowest bidder, as provided by Law, or to write new
proposals.
The attached statements, which are in compliance with Sections 103-a, 103-b and 103-d of
the General Municipal Law must be signed by the bidder.
In addition, corporate bidders must execute and attach a certified copy of a resolution
authorizing the execution of the non-collusion certificate by the signatory of the bid on behalf
of the corporate bidder.
No bid will be considered, which does not comply with the foregoing statements.

BID ADDENDUM
PRICE
Prices quoted are exclusive of all taxes. unless otherwise indicated on the Bid Proposal. Any taxes that you are required
to pay will be shown separately on our invoices.
PUBLICATION-BASED PRICING
Copies of the Journal of Commerce postings will be furnished only on an exception basis; they do not accompany the
invoice. Due to Federal Copyright protection laws, photocopying of other publications may be prohibited.
DELIVERY and BILLING
Deliveries made by tankwagon (small trucks) will be metered off. and copy of the delivery ticket will be left for your
reference. Whenever possible, this ticket should be signed by your representative. Please retain this copy, as no delivery
ticket copies will be sent with your invoices.
Deliveries made by transport (tractor-trailer) will be metered onto the truck, but will not be metered off. Whenever possible,
the hauler's metered bill of lading should be signed by your representative. A copy of the loading ticket and the bill of lading
will be left for your reference. Please retain this copy, as none will be sent with your invoices.
If 'your state requires registration of petroleum storage tanks, proof of registration will be required before deliveries
commence. Agway will not be responsible in whole or part for fines or penalties assessed on deliveries made to
unregistered tanks. Agway will not be responsible for fines or penalties resulting from buyer's failure to comply with
applicable Vapor Recovery Regulations. Buyer agrees to defend, indemnify, and hold Agway harmless from liability
arising out of Buyer's failure to register tanks as required, or to fully comply with Vapor Recovery regulations.
Storage tanks and related equipment must be sound and in proper working order. Access to the tank and fill pipe must be
clear and unobstructed.
Except in emergency situations, deliveries are made Monday through Friday between 8 AM and 4:30 PM.
ORDERING
WiII-ca1l deliveries (deliveries on demand) may require up to 48 hours advance notification. Automatic (degree day or time
frequency) deliveries can be scheduled at buyer's request, except for transport deliveries, which must be ordered as
needed. Penalty charges will apply on transport delivery if quantity ordered does not fit in tank, and on any scheduled
delivery when tank access is restricted.

The following information will be shown on our invoices.

Our State approved computer-generated voucher will be used if vouchering is required. As an alternative to vouchering
(at Buyer's request), we can apply a certification stamp to the invoice before mailing. This certification contains the
information that appears on most vouchers.

Our terms of sale are Net 30 Days. If terms are not adhered to, deliveries may be restricted (discontinued) and cash on
delivery (COD) payment required, at Agway's option.
SUPPLY
Our obligation to provide petroleum products shall not be binding or in effect whenever we are unable to supply these
products by reason of fire, strike, or labor dispute, interruption or shortage of supply, emergency or any other factor beyond
our control.
PRODUCT SAMPLING
Procedure for sampling and testing product: Sample must be taken from the delivery truck. Costs associated with product
testing will be paid by Agway if the product fails to meet our specifications. If product meets specifications, these costs will
be paid by you, the Buyer.

January 2, 1973. R. O. B. Gravel and Washed Gravel will be clean and well graded, and subject

Pursuant to your request and in compliance with "Information to Bidders" dated February 6,
2002, the undersigned hereby offers to furnish Crushed Stone which will meet the requirements
as specified in'the specifications of the New York State Department of Transportation, dated
January 2, 1973. R. O. B. Gravel and Washed Gravel will be clean and well graded, and subject
to the approval of the Town Superintendent of Highways. Washed Sand will be of the type
capable of feeding through an auger-type spreader.
Prices are to be submitted per ton and/or per cubic yard, F. O. B. Bidder's plant and delivered.
Length of haul, quality and availability of product will be considered in awarding this hid, and
the right is reserved to reject any or all bids.

BID ADDENDUM
PRICE
Prices quoted are exclusive of all taxes, unless othelWise indicated on the Bid Proposal. Any taxes that you are required
to pay will be shown separately on our invoices.
PUBLICA TION-BASED PRICING
Copies of the Journal of Commerce postings will be furnished only on an exception basis; they do not accompany the
invoice. Due to Federal Copyright protection laws, photocopying of other publications may be prohibited.
DELIVERY and BILLING
Deliveries made by tankwagon (small trucks) will be metered off, and copy of the delivery ticket will be left for your
reference. Whenever possible, this ticket should be signed by your representative. Please retain this copy, as no delivery
ticket copies will be sent with your invoices.
Deliveries made by transport (tractor-trailer) will be metered onto the truck, but will not be metered off. Whenever possible,
the hauler's metered bill of lading should be signed by your representative. A copy of the loading ticket and the bill of lading
will be left for your reference. Please retain this copy, as none will be sent with your invoices.
If"your state requires registration of petroleum storage tanks, proof of registration will be required before deliveries
commence. Agway will not be responsible in whole or part for fines or penalties assessed on deliveries made to
unregistered tanks. Agway will not be responsible for fines or penalties resulting from buyer's failure to comply with
applicable Vapor Recovery Regulations. Buyer agrees to defend, indemnify, and hold Agway harmless from liability
arising out of Buyer's failure to register tanks as required, or to fully comply with Vapor Recovery regulations.
Storage tanks and related equipment must be sound and in proper working order. Access to the tank and fill pipe must be
clear and unobstructed.
Except in emergency situations, deliveries are made Monday through Friday between 8 AM and 4:30 PM.
ORDERING
WiII-ca1l deliveries (deliveries on demand) may require up to 48 hours advance notification. Automatic (degree day or time
frequency) deliveries can be scheduled at buyer's request, except for transport deliveries, which must be ordered as
needed. Penalty charges will apply on transport delivery if quantity ordered does not fit in tank, and on any scheduled
delivery when tank access is restricted.

Our State approved computer-generated voucher will be used if vouchering is required. As an alternative to vouchering
(at Buyer's request), we can apply a certification stamp to the invoice before mailing. This certification contains the
information that appears on most vouchers.

PAYMENT TERMS
Our terms of sale are Net 30 Days. If terms are not adhered to, deliveries may be restricted (discontinued) and cash on
delivery (COD) payment required, at Agway's option.
SUPPLY
Our obligation to provide petroleum products shall not be binding or in effect whenever we are unable to supply these
products by reason of fire, strike, or labor dispute, interruption or shortage of supply, emergency or any other factor beyond
our control.
PRODUCT SAMPLING
procedure for sampling and testing product: Sample must be taken from the delivery truck. Costs associated with product
testing will be paid by Agway if the product fails to meet our specifications. If product meets specifications, these costs will
be paid by you, the Buyer.

Information to Bidders:
Sealed proposals shall be received by the Town of Wappinger at Town Hall, 20
Middlebush Rd., Wappingers Falls, New York, until 1:00 P.M. EST February 21. 2002
for 20,000 gallons of gasoline to be used by the Town of Wappinger.
Bids shall be submitted on this form and shall be enclosed in a sealed envelope marked
"BID FOR GASOLINE".
Bidders shall have a scheduled 24-hour delivery service, seven days a week.
Automatic check and fill service on delivery of gasoline shall be maintained.
All deliveries shall be metered and shown on a metered printed gasoline delivery ticket.
The Town Board reserves the right to reject any or all bids, to waive any informalities in
bidding and/or to accept other than the lowest bidder, as provided by Law, or to write new
proposals.
The attached statements, which are in compliance with Sections 103-a, I03-b and I 03-d of
the General Municipal Law must be signed by the bidder.
In addition, corporate bidders must execute and attach a certified copy of a resolution
authorizing the execution of the non-collusion certificate by the signatory of the bid on behalf
of the corporate bidder.
No bid will be considered, which does not comply with the foregoing statements.
