EST February 21. 2002 for 20,000 gallons of gasoline to be us~d by the Town of Wappinger. Bids shall be submitted on this form and shall be enclosed in a sealed envelope marked "BID FOR GASOLINE". PUBLICATION-BASED PRICING Copies of the Journal of Commerce postings will be furnished only on an exception basis; they do not accompany the invoice. DELIVERY and BILLING Deliveries made by tankwagon (small trucks) will be metered off. and copy of the delivery ticket will be left for your reference. Deliveries made by transport (tractor-trailer) will be metered onto the truck, but will not be metered off. Please retain this copy, as none will be sent with your invoices. If 'your state requires registration of petroleum storage tanks, proof of registration will be required before deliveries commence. Agway will not be responsible in whole or part for fines or penalties assessed on deliveries made to unregistered tanks. Agway will not be responsible for fines or penalties resulting from buyer's failure to comply with applicable Vapor Recovery Regulations. Buyer agrees to defend, indemnify, and hold Agway harmless from liability arising out of Buyer's failure to register tanks as required, or to fully comply with Vapor Recovery regulations. Storage tanks and related equipment must be sound and in proper working order. Access to the tank and fill pipe must be clear and unobstructed. Except in emergency situations, deliveries are made Monday through Friday between 8 AM and 4:30 PM. ORDERING WiII-ca1l deliveries (deliveries on demand) may require up to 48 hours advance notification.
