Subject: Bid award for Highway vehicle lift
Two bids were 'received. One from Hi-Tech automotive for $676:5,,00
and one from Automar NewEnglan~ Inc. for $8,992.00
'The Hi-Tech lift is operated with a chain which was contrary
to Our specifications which clearly stated Drive System: Direct
drive using no cables or chains'. B'ecauseof 'the difference in
price, I visited an inst.allation in Wayntskill, N.Y" last Thursday,
July 18, 1991. Terry Glass and I inspected the lift again on
Friday as well as the lift offered by Automaro
As a further deveopment,.I questioned the Automar price. of
$8992-000 which had originally estimated at $800-0.00 priceo
After a day of discussion, Automarhas agreed to honor the
$8000 price. . ' .
I reconnnend we dis~ualifythe Hi,..Tech lift because of the chain
drive and award the contract to Automar for $80000

be received at the office of the Town Clerk of the
Town of Wappinger, 20 Middlebush Road, Wappingers
Falls, New York, until 1:00 EST on the 17t~

bidding form and specifications which will be
available each working day between the hours of
8:30 A.M. and 3:30 P.M. at the office of the
Superintendent of Highways, 20 Old Route 9,
Wappingers Falls, New York.
The Town Board reserves the right to reject any
or all bids, to waive any informalities in any such
bids, or to contract with other than the lowest
bidder, as provided by Law, or to write new proposals.
Bids being submitted by mail should be mailed to the
Town Clerk of Wappinger, P.O. Box 324, Wappingers Falls,
N. Y. 12590.

The attached statements, which are in compliance with
Sections 103-a, 103-b and 103-d of the General Municipal

a certified copy of a resolution authorizing the execution

STATEMENT # 1
The undersigned represents that pursuant to Sections
l03-a and l03-b of the General Municipal Law of the State
of New York, no person referred to in the attached proposal
who is a bidder or who is or was a member, partner, director
or officer of the bidding firm or entity under this proposal
has refused to sign a waiver of immunity or to answer any
revelant questions relating to any transaction or contract
with the State of New York, any political subdivision thereof,
or any public authority, during the period of five years
prior to the date hereof. The undersigned agrees that any
contract awarded as a result of this bid may be cancelled
without penalty upon the grounds set forth in Sections
l03-a and l03-b of the said General Municipal Law. The
names and addresses of all persons and parties interested
in the foregoing bid are as follows:

signing on behalf of any bidder certifies, and in the case
of a joint bid each party thereto certifies as to its own
organization, under penalty of perjury, that to the best
of knowledge and belief: (1) the prices in this bid have
been arrived at independently without collusion, consultation,
communication or agreement, for the purpose of restricting
competition as to any matter relating to such prices with
any other bidder or with any competitor; (2) unless otherwise
required by Law, the prices which have been quoted in this
bid have not been knowingly disclosed by the bidder and
will not knowingly be disclosed by the bidder prior to the
opening, directly or indirectly, to any bidder or to any
competitor; and (3) no attempt has been made or will be
made by the bidder to induce any other person, partnership
or corporation to submit or not submit a bid for the purpose
of restricting competition.
