Re: Eugene Ossie, I nc. - Request for payment
Dear Supervisor Paino:
As you will recall, we had discussed two separate issues regarding this
contract. First, under the instant request for payment for all but
$10,000 of the contract, we had a concern under General Municipal Law
Section 106-b to confirm that there were, in fact, no liens or judgments
on the property. Secondly, we wished to make clear to Mr. Ossie that
final payment of the remaining $10,000 would not be made until the
releases of liens and consent of surety were obtained as provided in the
contract.
As to the first matter, I have had a I ien/judgment search performed at
the Dutchess County Clerk's Office and have confirmed that there are
no I iens or judgments filed against this property. Accordingly, I think
the requirements of Section 106-b have been satisfied and I have no
objection to the payment by the Town of the amounts due under the
contract, except for the $10,000 to be retained, by agreement, to cover
the work that remains to be done.

Secondly, as to the request for final payment, I discussed the matter
with Chuck Liscum today, who has been informed by the contractor that
he al ready has the surety's consent to final payment and will present
his releases of liens also, having agreed that these items are necessary
prior to final payment.
The architect also verified with Ossie that they will complete the
remaining items by Friday, August 29th. Naturally, if these items are
not completed, the Town has recourse under the contract to perform
the work itself and deduct a fair amount from the final payment owing.
