as follows:

The provisions of the Zoning Ordinance and Zoning Map of the

Town of Wappinger, duly adopted on the 10th day of March, 1980, and

as amended from time to time is further amended as follows:

I�jl 1. Section 477 of the Zoning Ordinance is modified as follows:
477 Driveways

477.1 General

For reasons of Fire Protection, Traffic and Pedestrian safety,

j both on and off street, as well as to provide for possible future road
widening or other improvements, all new driveways and sidewalk crossings
li
entering onto any street shall comply with all requirements of these

Regulations and shall be subject to the approval of the Superintendent
of Highways, except where such are part of a use subject to special
permit or site development plan approval, in accordance with Sections
430 and 450, in which case they shall be subject to Planning Board and/or
Board of Appeals.
2. Section 477 is further amended by adding the following:
477.5 Emergency Vehicle Access
Driveways and access roads shall be so designed as to
provide Fire Department apparatus access to within a
distance of no less than 150 feet of the structure it
may be called upon to protect and they shall meet the
following requirements.

They shall have a minimum width of 10 feet.

They shall have and maintain a minimum overhead
Clearance of 12 feet.

At the October 27th, 1986 meeting of the Planning Board the above mentioned
amendement was reviewed.
Mr. Fanuele made a motion to recommend the adoption of this section of the
Zoning Ordinance.

The Dutchess County Department of Planning has reviewed the subject referral
within the framework of General Municipal Law (Article 12B, Sections 239-1 and
239-m). After considering the proposed action in the context of countywide
and intermunicipal factors, the Department finds that the Board's decision
primarily involves matters of local concern.
This Department recommends that the Board rely upon its own study of the facts.
The Dutchess County Department. of Planning does not presume to base its
decision on the legalities or illegalities of the facts or procedures
enumerated in subject zoning action.
